Welfare ‘Dependency’: Hard Right Keeps Up the Pressure to attack the less Well Off.

The Centre for Policy Studies has a thing about ‘welfare dependency’.

The influential right-wing think tank – which most people will not have heard of – want people to stand on their “own two feet”.

Never mind that the Centre itself is headed by Baron Maurice Saatchi a man who made his money as a parasite in the ‘advertising industry’ , and is, well, you know, a ‘Lord’ in said House of, no doubt a position won by scrubbing floors and hewing coal.

We notice this on its funding (Who Funds you?)

We strongly doubt if this level of detail would satisfy those supervising our Job Search: Transparency rating D.

Their latest wheeze is to publish a report, ‘The Independence Revolution Must Go On‘, which says this:

  •  The Government’s record in reducing dependency on the State is strong, but there is plenty more to do.
  • Dependency has fallen by 2.7 percentage points since 2010, but over half of households still receive more in benefits (including benefits in kind) than they pay in taxes.Welfare reform appears to be reducing dependency. 19% of households subject to the benefit cap were in work after a year.
  • Children growing up in workless households have, on average, poorer key stage 1 attainments, lower cognitive ability and are more likely to be NEET.
  • New Government must continue incentivising work by reducing marginal tax rates and carefully evaluating the National Living Wage policy.

Anybody using the ‘verb’ ‘incentivising’ deserves a week-long course for those with language difficulties.

Boiled down what the Centre – remember a group with real influence on government policy – is suggesting is more benefit caps, more dependency on dodgy employers and charity and fewer rights at work and on benefits.

This article tackles the core assumption of the Centre: that redistribution of wealth from the rich, and the better off, to the less well off, and using benefits to help people stand on their own two feet, is wrong.

  • The Centre for Policy Studies (CPS) has issued an Economic BulletinThe Independence Revolution Must Go On’, based on figures from a recent Office for National Statistics publicationThe effects of taxes and benefits on household income’.
  • The ONS figures show that “over half of households received more in benefits (including  benefits in kind) than they paid in taxes for the  year 2014/15…It is estimated that 50.8 per cent of households are net dependents”. The closer one looks at these figures, however, the more questions arise about how we define dependency, who actually benefits from benefits, and how we think about the redistribution of wealth.
  • The CPS views the ONS figures largely in terms of ‘welfare dependency’, concluding that, “The Government’s record in reducing dependency on the State is strong, but there is plenty more to do.’ It even takes the opportunity to mention that “children growing up in workless households …have, on average, lower cognitive ability.” saying that, “This highlights the social cost of welfare dependency and need to reduce welfare dependency in society.” Even ‘the so-called ‘intergenerational transmission’ of worklessness’ gets a mention.
  • But wait a minute – as the CPS itself has just pointed out, over half of UK households are classed as ‘dependent’ because they are deemed to receive more from the state than they pay in. ‘Worklessness’ is a factor in only a fraction of those households. There is much more going on here.
  • If we view the same ONS data from a different perspective, it is possible to draw very different conclusions, and to raise questions about how and why people are considered ‘dependent’ on the state. (The data used by the ONS can be found in Table 2 here )

We can only endorse Meaden’s conclusion:

Reducing ‘dependency’ via welfare reform threatens this redistribution and may tip people at the bottom of the income scale into deeper poverty. As the ONS says in another publication, “Most recently, the average cash benefit rate has fallen which, along with decreasing progressivity, means that the overall redistributive impact of cash benefits has been reduced.”

More welfare reform, which will no doubt reduce this redistributive impact even further, seems destined to produce not independence, but increasing poverty and destitution.

  2. Lol, i read ONS’s outings yesterday and get a load of this exert,

    The Office for National Statistics has calculated “human capital”, which puts a monetary value on a person’s qualifications, age, health, personality and skills, measuring the total potential future earnings of everyone in the labour market.

    If how the labour market stats were already worked out isn’t bad enough, it appears we will be moving away from a guesstimate to pure speculation as its not like their going to inspect everyone personally is it.

    If im the example on qualifications and health coupled with my current financial and working status, the figure would be wildly out and that’s an understatement. Also if we shipped in a load of socio and psychopaths into the country, let them kill then locked them up we would have the same flaws that are possible in the equality equation as both parties are extremely intelligent not to mention often holding some very nice qualifications and positions even as far up as CEOs and government people.

    If i didn’t know better i swear this, the new measure equation on whose in poverty makes me think someones aren’t telling us public something, don’t you think ?

    PS: I wonder will they be deducting points for all our bad English and math online in an effort to keep the figures real ?

    • A rule of thumb if you want to improve your math is to acknowledge that most of the time, not all the time a person gives you a % of something, it usually means the actual sum total, the bean counted head total does not look that pretty.

Housing benefit is rising exponentially not because the poor are living in accommodation too expensive for them but because rents are too high – THAT is the scandal in respect to housing that people should be talking about. Half the population receive more in benefits than they pay in taxes because they can’t earn enough from work to manage otherwise; too many people are given too few hours at too low a pay rate to survive without assistance and THAT is the scandal in respect to earnings and benefits that people should be talking about.

    These wankers always draw false conclusions based on their own bias.

    Here’s a story: A man investigating how fleas jumped performed a cruel experiment. First he trained a flea to jump when it heard a noise and measured the height of the jump. Next he cut off two of the flea’s six legs, made a noise, and noticed that the flea on jumped two-thirds as high. The he cut off two of the flea’s remaining four legs, made a noise, and saw that the flea only jumped one-third as high as the first jump. Repeating the foregoing he removed the flea’s last two legs, made a noise, and noticed that the flea didn’t jump at all.

    His conclusion: Fleas have ears on their legs and removing flea legs progressively prevented them from being disturbed by noises until, when all the legs were removed, the flea became deaf and didn’t respond to sound at all.

    Stupid is as stupid does and these so-called “welfare experts” spend their time doing very stupid things.

    All very well but nothing about barriers to work or ever important today finding and securing employment,standing on own feet with the need for tax credits,child benefit and the for some form of state entitlement when Osbourne resorted to threats to try and force an ending to credits ignoring the need for top ups,employers paying below the minimum wage an opposition which at the time foolishly belived that an election could be won at the expence of people on benifits.

    Those that are standing outside jobcentres repeatedly waiting to open when spoken to don’t have any qualifications that are adult related and often none combined with increasing age,applying for the usual more then 10 applied often 75-100 mostly agency ads’ standing on own two feet seems a long way off.

      • When I’m sick I go to a doctor to be diagnosed, not to the DWP. In my view it is doctors who should assess sickness, disability and fitness for work not the DWP and certainly not private, profit making firms like MAXIMUS, who actually get paid more for every person they test and find fit for work than for those they don’t. Harassing a disabled person like Emily above, whose handicaps will be life-long and never go away, is pointless verging on the sadistic.

      • The interesting thing about the DWP/ATOS/Maximus assessment is that they tell you, right at the start of it, that they disregard all medical history and will be basing the decision on what the investigating officer finds. It doesn’t matter one jot that, like me, you have had the condition/ llness/disability for most of your life. It doesn’t matter at all because it is nothing more than a monetising exercise for all the departments. ( DWP/Jobcentreplus ) and the companies such as ATOS and Maximus. The more you get shifted from one agency to another, the more money is paid to those agencies because each decision made by the individual agencies incurs a fee. More money for them and more stress for the ” claimant “.

        Doctors are not truly independent. They are part of the local community. They are too ingrained. They can be subjected to bullying, harassment and intimidation. Some doctors will do anything for a quiet life. Back before independent assessments doctors were handing out sick notes like sweeties. In the same way they hand out prescription drugs that get sold on.

        Oh sure, the malingerers would love to go back to the days of being signed off ‘sick’ by their anything-for-a-quiet doctor down in their local surgery.

        We are not fucking stupid and neither is the Government.

        There is money at stake here. Public money. Money that people actually work for and pay in taxes – it has to be protected from fraud and abuse.

        In any sphere an assessment, test, exam which involves the potential for fraudulent gain has to be carried out by an independent examiner.

        You may as well say: “Why can’t my mum assess me for my Driving Test?”

        That’s pretty moronic, sport. Driving is a learned skill and the test a measurement of competence in respect to an acquired ability and competence. The Work Capability Assessment is supposed to be a measurement of how physically and mentally a person is in respect to doing entering the workplace: sickness and disability are innate not learned and so cannot be assessed fairly by a one-size-fits-all standardised examination Hence medical and psychiatric reports having to be drawn up by qualified doctors in respect to people being tried for crimes, in order to determine sanity and responsibility as far as sentencing goes; trying to use a check-box points based test to determine whether somebody is answerable for what they have done would be widely criticised if introduced into the justice system globally. Why? Because disability and sickness are untidy and present differently, at different times, to those afflicted: A simple, standardised test like WCA, carried out by the medically inexpert, could never fairly assess physical and mental competence sensitively or accurately. Hence thousands of people being found fit for work by the WCA dying within weeks of being declare work-ready and the, probably, hundreds of thousands of successful appeals against WCA decisions won by people falsely found fit for work when they were anything but.

        Many thousands of perfectly innocent and deserving people have been harassed to death by the current regime, some of the frailest and most vulnerable being driven to suicide as their lives became too much for them to bear.

        This isn’t the way any civilised country should behave.

        Labour, Conservative and Liberal Democrat parties are jointly responsible for this atrocious mess.

        Er, no. My disablity is very very visible when I point it out. It was that this was so – say to claim for parking, but it is no longer the case. I can’t point you to the particular Equality Act but it was simplified to reduce the costs to all parties and, basically make it simplier.

        You appear to be making things up and putting them in other people’s mouths.

        Where did I say that a person’s own local family doctor should be the one to test to determine whether a person is fit for work or not? What I actually said was that a “doctor” should do the test and by “doctor” I meant a properly qualified and experienced general practitioner, not necessarily known to the person in advance, who has access to and examined the tested person’s medical notes and history. This is the only way in my opinion that a valid opinion in respect to any person’s health can be determined fairly.

        To be honest you seem to have no idea about anything you’re commenting on.

        The scam maximus and Atos ran and run requires misdiagnosis which would mean the action when over turned in tribunal gives the claimant legal action to instigate proceedings for malpractice.

      • The truth be told the reason that the criteria for disability benefits was tightened because the system was inherent with fraud. I had an uncle who used to take a walking stick on his very occasional visit to the DWP doctor. There was absolutely nothing wrong with him. He used to laugh and joke about it: “Why have you got a walking stick uncle?” “I am going to see the DWP doctor 😀 “. He was an extremely fit man who used to mountain-climb and all sorts of extreme physical activity and had even financed a trip to the Himalayas on his ‘disability’ benefits.

        In those days all you had to do was walk a few yards up a hill and fall over in the street to quality for disability benefits. The system was a joke! We all know it, but some of us just don’t want to admit it. And that is the reason it was tightened up. Again, we all know it, but some of us just don’t want to admit it.

        If anyone is to blame to for the increased scrutiny on genuinely disabled people it is those who were taking the Micheal with the system, and it is those very same people who cry out with: “Why can’t my doctor assess me? They know my condition better than anyone.” Human nature always wins and if there is ‘free’ money going some unscrupulous people will take it.

      • Okay, Nescafé. I am always suspicious of anybody who quote as being” verbatim ” information such as you appear to have done.
        Where did you get this information from?
        Were you an eye-witness to this incident, or was it something along the lines of it being in an article that you read online?

        Do you realise that the level of ” benefit fraud ” is actually less than one per cent of the total amount paid out?
        The latest figures that I have awareness are from either 2014 or 2015.
        ( there is a time lag associated with such information )
        It showed that of the level of fraud in the benefit system was zero point seven of one percent. ( 0.7% )

    • Personal debt in the UK is massively high Enigma and if you consider subtracting this and other debts like the national debt and mortgages if not included in that personal debt, you will see wage rises, job creation and such is far less progressive than our government and financial sector would have us believe.

      The GDP in the UK is built on massive bubbles so like the sub prime mortgages disaster, another massive crash globally is just around the corner so its not a case of if but when and considering austerity is near boned, our options the next time round will be extremely limited.

      • Actually Andrew Coates no as debt is what gives the money in your pocket value and its been that way for decades.

        Theirs not enough gold in the world anymore to back money so in effect IOUs are required and hence debt.

        The drive to put us all in debt is to repair the damage of all the stimuluses that have reversed this effect.

        What the worlds leaders have done is basically put on hold those pounds you have sinking into a minus or possibility worse negative. So if they cant get us into debt you can imagine the result.

        I know it sounds crazy but saving is negative to money, but i wont go on as its a complicated process to explain and neither you or i have book size time to discuss it.

      MRN 14/08/2016

      The 12th falls on a Friday, the 14th falls on Sunday. So now add a 1st class letter takes a day while 2nd takes 3 working days so not Saturday, not Sunday as their not classed working days meaning if and only if 2nd class would mean the letter wouldn’t arrive until Wednesday the 17th and if it was first class it would be the 13th but as we know or at least i do anyway as an once upon a time ex Tax officer, the mailroom would have been shut on Saturday and Sunday still meaning this decision maker count not have received it before the 15th.
      Now theirs nothing to say they weren’t and it was overtime but DWP list their offices as shut Saturday and Sunday so how comes the notice is dated 14th which is a Sunday.

      Did you notice this Gazza as not here or rightsnet has a single sole person mentioned what i just have ?

      Lastly why don’t we have the date of the day this person was dew to attend or was failed to attend, their was no problem supplying the other dates, why not this ?

      The MRN must be the date of when it was actioned if we assume someone was working that day as it cant be the day the claimant received it as that’s a Sunday.

      Knowing what DWP are like as remember further down its cited this person was possibly sanction prior to this one so this claimant is no stranger to DWP tactics so WHY didn’t they ask their employer to right it out the day they worked so they could take it to the JCP when they did turn up as you still have to go in the moment your are not working.

      Now their might be a legit reason which again surrounds dates hence my curious and cautious approach to this post at rightsnet.

      All thats happened at this stage if someone did work at DWP on Sunday the 14th is the evidence failed to reach before the decision was taken so as far DWP complying with their own policy, they have done no wrong.

      ALL IS NOT LOST THOUGH as once they go to their local councillor this can be reversed and case closed.

        I have never heard of DWP DMs working on Saturday/Sunday so this is a new one – there is NO Overtime so this has gone from fishy to high stench to me. And as you point out there is no posting on a Saturday/Sundays. As for dates the reported dates must be from the dates of the letters which nails it dead about being any other day.

        It begs the question. If dated Saturday & posted on that date, how did the person get access to DWP premises on that day? How did the letter leave the closed premises on that day and get inserted in to the Royal Mail delivery pipeline?

        If as I suspect that the claimant falls under Equality act, I pray they take them to the cleaners – it is clearly a fit up. But as we have come to expect and know with DWP the Mangement Roaches are so useless they couldn’t shit in a bucket even if you tied it to their backsides [sorry for the graphic imagery – but its spot on in my view].

      • DMs will have all been long gone by 3pm Monday to Friday as will have most of the other staff. I’ve passed cockroaches after they have just left the jobcentre at around about 2:45pm. There is only a skeleton staff left in jobcentres at 4pm. And only the G4s guards left to lock up at 5pm. Have a look in the next time you are passing a jobcentre and see all the empty cockroach desks… they will have all scuttled off 😉 … they very same cockroaches who tell us we should be working every hour God sends. Anyway, to even suggest that a DM would come in on a Sunday is preposterous.

      • The common mistake is to think JCP and DWP are the same department when in fact their not. JCP is in effect customer service, the frontline for DWP so working time for the two can and are different.

        While the classic 9 to 5 is still very much alive at DWP in particular, government took the tact to split a job so as to cover their bet as so to speak. You’ve only got to remember both staff listed as part time are consistently threatened with no contract renewal if they don’t meet targets or do as their told (you know, lie, mislead,twist), which is very real. This wouldn’t be so easy to do if all were full time meaning government would have had to employ more full time staff than required to cover or face delays and thus push up the staff bill they have been desperately cutting. Part timers give government wiggle room on a system already under pressure.

        ANYWAY LETS TALK MANDATORY RECONSIDERATION AND THIS CASE.

        Well and yes how convenient, a MR time length is , “how long is a piece of string”, meaning a day to a year, theirs no statue on it believe it or not. That aside if we go by the dates supplied DWP or private company like Concentrix for instance a company paid on a payment by results basis took a mere 6/7 days to process the MR but how does that fit with, WHAT IS A FAIR TIME TO ALLOW A CLAIMANT TO SUMMIT EVIDENCE ?

        Well neither the claimant or DWP can control the time of this claimants employer replying and as businesses are often busy and MRs arent their regular concern or legal obligation, i would argue legally the time allowed in this case to produce evidence is insufficient as the only way to truly establish the employer as being the employer is a letter headed letter. Well if like DWP this employer does 2nd class, the employer was only allowed 1 DAY so summit evidence.

        You see while you all became beguiled by whether or not a DWP employee or contractor actually worked on a Sunday, yet again failed to clock the point i just made.

        So the legal argument is DID the DM provide the claimant with sufficient time to produce evidence and clearly as i have demonstrated NO they did not and completely disregarded the fact not only that both the claimant and employer are working and in the case of the claimant mandated by regulation to look for work up to 35 hours a week in order to receive benefit in the first place, completely disregarded the fact post does not flow at weekends besides what was sent 1st class on Friday before 7.30pm. If and only if the employer did send 1st class Friday, the DM would have their hands tied explaining how they didn’t receive the evidence before making a decision.

        If this claimant was on my caseload, this would be a slam dunk case as if DWP refused to engage on my very valid points, i not only would easily win in tribunal, the judge panel would berate DWP on not only wasting tribunal time but effectively wasting taxpayer money as well by being totally unreasonable.

        In reality however i would need more data than 3 mere dates to be conclusive as i could possibly find more damning evidence against DWP so this Derbyshire Welfare Rights Service should be ashamed of themselves in not seeing the obvious and i will be ringing them after 9am to point this out and give them a piece of my mind about how unqualified this representative is and how perhaps this advisor might be better placed in another industry that does not revolve around giving people advice where a lack of knowledge could and frankly would be detrimental to their client.

      • Im glad you both think so as all to often peoples judgement is clouded around the issue with usually either side dismissing the other on a fruitless basis.

        As you can see in your own realities what he prescribes is happening is exactly that in reality and a prime place to see the drop in standards is in the cleaning industry where rather than have in house cleaning staff, the work is contracted out to firms who under price their tender so to recoup such a loss set impossible time targets for cleaners that tend to lead to poor service which in certain hospital cases has lead to the spread of disease or a high risk of it that thankfully was averted.

        Now some may have seen a recent BBC show which takes people from other trades often semi to skilled trades whether current or prior but in fairness i assume also some non skilled like a domestic house cleaner.
        Well the first task was cleaning a certain amount of hotel rooms in groups of 2 on a single floor with a time set at 24 min per room.Well the end result was if i remember right, only one room was of a standard to be given out on an entire floor or if wrong, wing. All even the domestic house cleaner couldn’t get it right.

        Now openly said on the programme, the hotels contractor for cleaning cleaners are all foreign and interestingly enough the contestant that did score the highest involved sure enough a foreign woman.
        You see the foreigners we speak of come from countries that for ever have their staff working at bullet pace inorder to produce revenue for their economy as they lacked competent education with often kids as young as 8 working to hep compete against the rest of the world, often countries were agriculture is the main stay of work in order to keep the country feed such is their economy and this has nothing to do with the 2008 crash but this did only serve to make it worse.

        Then we have the sweat shop industry, transfer/relocation of industry and on and on it goes pushing wages and thus living lower and lower. Now in the UK their NLW so theirs a point these businesses cant undercut so what they do is instead create unrealistic targets so as to tender for even more and thus move from quality to quantity just to make a profit. As is the case and clearly seen from this program, UK citizens by far and large cant compete with the such Europeans on speed that maintains good service in cleaning so we see these businesses selecting certain EU migrants over not only UK citizens but also certain European countries like say France or Italy for instance. So systemic is it that often businesses or recruitment agencies will go abroad to sell themselves to such poor countries and then kid us all they were fair in employing who they chose. Is this ethical, no it isn’t but non the less it goes on and government does nothing to prevent it because their still getting the revenue so despite all this don’t want to work crap, they place this practice over the needs of their very own country public to hide the fact.

        Now as time progresses the UK citizen will develop the timing which means the poor polish for instance now have no choice but to go home and lose a revenue stream and so their countries economics plunges once again with all the while such businesses not giving a crap you have no money to feed their 6 year child let alone themselves.

        This is but one aspect of one part of the problem with capitalism and why if your unemployed and a british born citizen your often rejected for such non skilled jobs, an issue i doubt an advisor is knowledgeable enough to even be aware of let alone take it into consideration when they accuse certain claimants of not putting enough effort in securing work. You see when you get rejected employers and DWP constantly say your the problem when infact its their ideology that is and why their now so desperate to push the unemployed and school leavers into unpaid work experience for nothing but their measly 73.10 which if you do say 35 hours a week means your valued at a piffle £2.08 an hour to live on which is 28% of the NLW they say a person rock bottom needs to live on and why people leaving the unemployment are still heavily state dependent and why tax credits and housing benefit exist today meaning despite being in work, the Tory government has indeed failed in its pledge to make work pay.

        I don’t know about others but i ask questions at interviews and i always speak my mind and theirs many a time ive seen fear on employers faces when they realize Ive bubbled them and their dirty skanky practices of abusing employees for the sake of a buck, the same fear i see in recruitment agencies which has resulted in certain agencies refusing to put me on their books or when i get DWP to intervene, i go on the books but never get a phone call and why they then proceed to lie to DWP that work has dropped off, a certain best connections being one of them who made alongside transline made 50 million from sports direct in just shirebrook.

        According to this particular best connections they lost my paperwork yet when i mentioned they only have 4 office rooms on one floor with walls and closed windows so it shouldn’t take that long to find it so i will wait, instead called the police behind my back and lied bare face to them that i was being hostile and they were in fear when the truth was i was calm, collective and happy as why wouldn’t i be when we all are when we know we’re right. In this case i also additionally uncovered how their committing tax avoidance through umbrella companies with my extensive prior knowledge of tax law what with starting out life working for the tax office as a civil servant. I also uncovered their shady practice of hiring certain EU migrants from certain countries as reps and office workers directly in employ at best connections so as to hide recruitment drives abroad by saying they went home to see their parents which im sure they did but non the less while their instructed fellow country people to come to the UK and sign on at best connections and we will give you work. This way this particular best connections would not been seen to be behaving inappropriately and unethically. Im sure if i persisted i would find a link between the slumlords renting properties out to these foreign workers with best connections but i didn’t so who really knows.

        Oh before i finish that best connections office later said my paperwork was lost while posting it to an employer yet when i said so you have breached my data protection then, they replied no as their was no personal information on it to which i replied if that’s the case then how do they know who it is your recommending,naturally they couldn’t answer but this time, i didn’t stick around for them to lie to the police a second time but i did record it and play it to DWP so they couldn’t sanction me for a problem i didn’t create.

        Infact if you look at him in wikipedia its stated i quote, ” Throughout his life, John James avoided personal publicity and little evidence remains of his character” so he cant even be tied to a charity or cause at the outset to when he died in 1928.

        Now after that as time progressed sainburys went from a family owned business to the completely unrecognizable establishment it is today who have no if any ties at all to him. So if for argument sack sainsburys did say today “if it wasn’t for us” then they would be in effect plagiarising a dead man.

        So do you see how it does not stack up in the light when mostly all business owners or investors declare their the wealth creator and curing poverty.

    Compliance with Data Protection Act and Information Disclosure

    The contractor must ensure that there are adequate arrangements in place for collecting, processing and sharing customer information.

    It is important to remind a customer of the DWP confidentiality statement which they signed when they first made a claim to benefit. However, a customer’s signature does not constitute “consent” at all and does not eanble any sort of data sharing or disclosure. It simply provides a degree of reassurance that the DWP will handle personal data fairly and lawfully.

    There is no specific “legislative enabler” which gives a provider the ability to gather or share customer’s information with a third-party, for example an employer or another training provider, for the purpose of
    placing the customer into training/work and obtaining outcome related payments from the DWP. The informed consent of the individual must be obtained beforehand, in line with the requirements of the Data Protection Act.

    The information disclosure consent form* must, as a minimum contain the following information:

    – what customer’s information your organisation will collect;

    – why the organisation needs the information, for example for the purpose of recording the numbers of customers placed into training and/or employment, monitoring the effectiveness of the service and reporting outcomes to DWP and claiming associated payments;

    – how the information will be stored;

    – when and why the information will be shared with a third-party, for example an employer will be contacted when the customer starts work within so many weeks of leaving provision for the purpose of employment so that a job outcome payment can be obtained from the DWP.

    Your organisation needs to made it clear to customers that giving consent is voluntary and that refusal to give consent or withdrawal of an existing consent will not effect any benefit they may be entitled to.

    Authorisation to contact an employer to obtain evidence of employment must be expressly stated by the Provider before any information dislosure takes place. Renewal of consents needs to be confirmed at every intervention.

      • If you all flick way way back on this very site this topic was covered at the very least 5 years ago so if claimants are unaware of it then they only have themselves to blame.

        They cant insist and you cant even if DWP instigate a sanction do so under non participation as it requires your legal consent which under the definition of law CANNOT be gained through FORCE,THREAT or DECEPTION.

        You see no matter what DWP attempt to say the provider remains in definition of law a third party meaning if they wish to become second, they need your lawful consent in the same manner DWP gained it. As for getting the police involved, pure hog wash as its not a criminal offense it civil and classed as a breach of regulation. If you have a breach you report it ICO and these days you go to their website and report or if changed email them which was the case the last time i did it against DWP. ICO will investigate and if a solid case presents itself ICO will order the ACCUSED to do what they dictate and in some cases a fine. If people want their pound of flesh then on the strength of ICOs results in such clear cut cases one could seek legal civil redress but that my people is going to cost you more than your Giro.

    • Just UC, yeh right, i signed on for JSA and its taken them 1 month and 3 days to pay me and even then its been one error after another like it took them 2 weeks to see me for my first interview, i still don’t have a regular advisor, the first advisor i did see miss booked me and DWP cut me off last week as he dated i should attend this Monday.

      Now i don’t know if its disgruntled workers but its been a dogs dinner thus far so i dare not think what poor UC claimants are going through. Oh my last working contract, engineers were so skint the boss use to pay us weekly and that was what went on not just in our company but many a contractors company so im not so sure monthly payments are the norm anymore but their again i don’t fill shelves or mop floors yet so who knows.

      If it wasn’t for the fact i work all over the UK so get an expenses handout to pay for hotel and dinner only, i would have never made the day let alone my first week and as anyone that does that type of work will tell you, working away is expensive so your wages disappear really quick.

    • I’ve just taken a part-time job with a company that uses a lot of casual labour which pays it’s workforce – all of its workforce! Including managers and clerical staff! – on a weekly basis. This is because a lot of the staff don’t work for the company for long, some staff only working for a few days now and again depending upon the company’s pressure of work. A lot don’t remain on the payroll for as long as a month. So this crap about Universal Credit “mirroring the word of work” where everybody who has lost their job has a month’s salary in their pockets before having to claim Universal Credit is bollocks. Millions of people are on piece work, zero hour contracts, weekly or even daily wages paid in hand and for them a six week wait before they can get access to Universal Credit – which, don’t forget, includes housing benefit, meaning that your landlord won’t get their rent until you get your first UC payment forcing you to fall into into permanent arrears unless you can pay your rent yourself from savings – will be agonising. Being on UC means that 65% of whatever I earn will get stripped from my current Universal Credit entitlement meaning that I will remain too poor to get off UC completely, will remain on UC for the foreseeable future, and therefore won’t have to reclaim. For people with no savings who have been on weekly wages, or similar, claiming UC for the first time will be hellish. And sadly it will be people in insecure and low paid employment who WILL be forced to claim Universal Credit in order to survive in an unpredictable world of minimum wage insecure work.

      What kind of a responsible government could have done something this stupid and pernicious.

      As more and more people end up on UC its inherent nastiness and maliciousness will be unignorable.

      It will be interesting to see how long a crap government can defend such a completely crap policy,

      • Ahh, how you forget Tim how NLW increases will push quite a reasonable number claiming tax credit and housing of the stats and thus giving the appearance that its working when all that means for those workers is having do redress while suffering in silence juggling heat light and food.

        Those under the 30 hours who don’t have kids working part time will be at constant odds of watching their hard earned labour cancel out what benefits they do get yet remain forever under the condition of looking for work or face sanction of their housing benefit what with their earnings already having cancelled out their unemployed benefit first. They will see no difference between being unemployed and employed, trapped in a revolving door, trading UC conditions for employer conditions (you will make 30 things an hour,clean that room in 10 minutes or else) with the bodies that be claiming its just business, its nothing personal.

        Well why would it be personal, neither know or care you exist beyond the burden you may cause them.

        At least under the old system if you had a part time job you could claim housing only without strings and thus at the very least allowing a portion of your life to be truly yours and yours alone or put another way, “finding peace in solitude” that’s yours to control rather than being consigned to.

      • What they tell you about being better off if you work a certain amount under Universal Credit is nonsense too. Because my council tax will go up when I’m working part-time, basically, I’ll be about £20 to £25 per week better off working for 27.5 hours a week, in the evenings, after my UC and housing benefit entitlements get reduced. Not much of an incentive to get off benefits and do what work becomes available to you. My UC is suspended at the moment until I tell the DWP my employer’s PAYE number, which should be on my first payslip I’ve been told, for the DWP to find out if monthly details of my earnings can be accessed from HRMC to enable them to work out what my UC should be on a monthly basis; if the HRMC real-time system can’t take up the slack I’ve got to phone up with the details of my earnings monthly myself.

        (I suppose if I supply the financial data required the DWP checks it in some other fashion.)

        People who are still claiming that Universal Credit is a simplification of the benefits system and a cure for poverty need their heads examining. What really happens is that UC front-loads a whole new raft of things that the individual claimant has to do to retain his/her entitlements.

  43. UPDATE ON CLAIMANT SANCTIONED FOR WORKING #########################

    Well Mr Andrew Dutton of the Derbyshire Welfare Rights Service was busy yesterday and my time limited to so it wasn’t until half an hour a go we finally spoke to each other.

    Well the claimants family actually took the tact to contact their local Councillor whose aids have started to chase it up. Sadly and in poor form however DWP/JCP have refused to talk to them on the grounds they failed some sort of security question. Naturally most aggrieved the Councillor took the mantle directly and pursued it. Currently as i was informed despite the obvious prestige of being a Councillor, the runaround mantra continues as the councillor gets denied access after access to the people in a position to take a long hard look at this oh so obvious malpractice case.

    I intend to stay in contact with Mr Dutton and rightnets to see how this case moves forward so will update you not that maybe it wont be declared on rightsnet itself of how it all ended.

    Well its the weekend closing in so stay safe, stay warm and may you all i hope have a pleasant bank holiday Monday.

    Oh – if you know anyone sanctioned this week, find them Monday and buy them a some food and a pint.

    Nearly a quarter of a million children from poor families will be hit by the extended household benefit cap due to be introduced this autumn, according to the government’s latest analysis of the impact of the policy.

    The new cap will take an average of £60 a week out of the incomes of affected households, almost certainly pushing them deeper into poverty. About 61% of those affected will be female lone parents.

    Lone parents I seen many of in the local JC, all soon to start work in Butlins, on zero hour.

    The Scottish Greens said too many people were “stuck in jobs that are badly paid and insecure”.

    Co-convenor Patrick Harvie added: “It’s welcome to see the Scottish government talking about replacing the Work Programme and Work Choices schemes that will be devolved next year but it remains a concern that they have not committed to adopting our proposal to block the DWP from continuing to apply benefit sanctions, which cause hardship, harm people’s health and set back their journey into employment.”

        Moderate is a word, a meaningless word and quite frankly spoken from some westerner who and im being kind when i say this, i suspect hardly knowledgeable in the topic, blinded by their own agenda, deliberate as that may be.

        People forget the concept of fracture and mutate or more commonly put, divide and multiple exponentially. You see we can talk politics, religion, economics, whatever you like, it matters not as eventually a part will differ, will separate and so give birth to another even if it remains in the same body. this systemic pattern will eventually multiple and so on and so on and so on.

        Blue blood attitudes benign or otherwise, never last, never come to true fruition and you will witness this again when a consolidated and finalized caliphate does not appear anymore than the UK will become all British.

        The natural order of things simply makes no allowance for stagnation or repetitiveness where forward motion is denied. For man is man and religion an idea, based upon circumstance and relative perspective when uttered. Their are no facts, just meta theories.

    I have for years tried to explain to people the inherent dangers of a private police force, and funding for same via fines.

    This article concentrating on the city where the riots broke out after the shooting of yet another black person illustrates the blatant and also subtly of the dangers.

    Population mostly black and poor, yet same population is fined to fund the police force [yes, the funding of your own oppressors is heavy here], and also being criminalised by same and sent to the even poorer poor house – even if you’re poor already. And the icing on the cake is the fines also funds the bonuses for those who came up with this scheme.

    It was only AFTER the killing that the FBI stepped in and in investigating the whole police structure found this targeted rotten scheme.

    I can think of no way – considering how companies are protected from disclosure – how if private/governmental polices forces would be exposed here in the UK if they did this.

    • But the police are effectively the biggest gang in town – they represent of power and authority of the State. Once they are not longer under the auspices of the State and are merely a rag-tag bunch of ex-Jobcentre G4$ goons running around that that ‘authority’ is diminished, diluted and ultimately lost. They just become another common or garden gang and In those circumstance the populace is more likely to fight back. Look at what happens in the States when you up the ante – A ‘routine traffic stop’ commonly becomes a shoot-out! They gun the cops down over there without batting an eye-lid. Sweet justice some may say since the cops have been gunning down citizens over there for years – and getting away with it. Ditto the UK!

  55. Few people know that the number of financial penalties (‘sanctions’) imposed on benefit claimants by the Department of Work and Pensions now exceeds the number of fines imposed by the courts. In Great Britain in 2013, there were 1,046,398 sanctions on Jobseeker’s Allowance claimants, 32,128 on Employment and Support Allowance claimants, and approximately 44,000 on lone parent recipients of Income Support. By contrast, Magistrates’ and Sheriff courts imposed a total of only 849,000 fines.

    Sanctioned benefit claimants are treated much worse than those fined in the courts. The scale of penalties is more severe (£286.80 – £11,185.20 compared to £200 – £10,000). Most sanctions are applied to poor people and involve total loss of benefit income. Although there is a system of discretionary ‘hardship payments’, claimants are often reduced to hunger and destitution by the ban on application for the first two weeks and by lack of information about the payments and the complexity of the application process. The hardship payment system itself is designed to clean people out of resources; all savings or other sources of assistance must be used up before help is given.

    Decisions on guilt are made in secret by officials who have no independent responsibility to act lawfully; since the Social Security Act 1998 they have been mere agents of the Secretary of State. These officials are currently subject to constant management pressure to maximise penalties, and as in any secret system there is a lot of error, misconduct, dishonesty and abuse. The claimant is not present when the decision on guilt is made and is not legally represented. While offenders processed in the court system cannot be punished before a hearing, and if fined are given time to pay, the claimant’s punishment is applied immediately. Unlike a magistrate or sheriff, the official deciding the case does not vary the penalty in the light of its likely impact on them or their family. If the claimant gets a hearing (and even before the new system of ‘Mandatory Reconsideration’ only 3 per cent of sanctioned claimants were doing so), then it is months later, when the damage has been done. ‘Mandatory reconsideration’, introduced in October 2013, denies access to an independent Tribunal until the claimant has been rung up at home twice and forced to discuss their case with a DWP official in the absence of any adviser – a system which is open to abuse and has caused a collapse in cases going to Tribunal.

    Yet the ‘transgressions’ (DWP’s own word) which are punished by this system are almost exclusively very minor matters, such as missing a single interview with a Jobcentre or Work Programme contractor, or not making quite as many token job applications as the Jobcentre adviser demands.

    How did we get to this situation? Until the later 1980s, the social security system saw very little use of anything that could be called a sanction. Unemployment benefits were seen as part of an insurance scheme, with insurance-style conditions. Any decision on ‘disqualification’ (as it was called) from unemployment benefit was made by an independent Adjudication Service, with unrestricted right of appeal to an independent Tribunal. The maximum disqualification was 6 weeks, and those disqualified had a right to a reduced rate of Supplementary Benefit assessed on the normal rules.

    ‘Sanctions’ are almost entirely a development of the last 25 years. The British political class has come to believe that benefit claimants must be punished to make them look for work in ways the state thinks are a good idea. Yet the evidence to justify this does not exist. A handful of academic papers, mostly from overseas regimes with milder sanctions, suggest that sanctions may produce small positive effects on employment. But other research shows that their main effect is to drive people off benefits but not into work, and that where they do raise employment, they push people into low quality, unsustainable jobs. This research, and a torrent of evidence from Britain’s voluntary sector, also shows a wide range of adverse effects. Sanctions undermine physical and mental health, cause hardship for family and friends, damage relationships, create homelessness and drive people to Food Banks and payday lenders, and to crime. They also often make it harder to look for work. Taking these negatives into account, they cannot be justified.

    Benefit sanctions are an amateurish, secret penal system which is more severe than the mainstream judicial system, but lacks its safeguards. It is time for everyone concerned for the rights of the citizen to demand their abolition.
