High court bid to end discrimination against Legacy Benefit claimants.

This has been an issue our contributors have long been concerned with:

Universal Credit increase: High Court challenge piles pressure on DWP to extend £20 uplift to all benefits.

The Government has come under renewed pressure to raise the value of all benefits in line with the increase ministers introduced for universal credit claimants at the start of the pandemic.

It comes as the High Court gave two people on employment and support allowance (ESA), one of the benefits being replaced by Universal Credit, permission to challenge the Department of Work and Pensions’ (DWP) policy on the uplift, which they claim is discriminatory.

In March 2020, the Government announced that people on universal credit and working tax credit will temporarily receive an extra £20 a week to cope with the disruption caused by coronavirus, but stopped short of extending the increase to people still on the old benefits system, many of whom are carers and those with disabilities. Nearly two million people on ESA have missed out on the uplift, worth £1,040 a year.

The High Court’s decision to grant permission for the claim to be heard shows leaving out certain benefit claimants from the £20-a-week increase is arguably “unlawful”, he said.

“People dependent on the basic allowances provided by benefit payments are facing higher living costs during the pandemic. However, there is a difference in treatment between those on universal credit and those on legacy benefits, despite the fact that claimants in each group may have very similar circumstances.

“It is therefore welcome that this difference in treatment will be scrutinised by the High Court, particularly given the fact that almost two million disabled people are disproportionately affected by this decision.”

  1. Not giving the £20 uplift payment to the legacy claimants, was totally wrong and entirely unjust from the start.
    At least now we will have this tested in court. Something like this should have been done months ago, by DPAC and others.

      • @Andrew Coates – I hope we are not going to see any DWP dirty work here, and they just pay the ESA claimants, but not the JSA. If this case is upheld by the court, then all those on legacy benefits must get the £20 increase.
        Not only the 2 Million Employment and Support Allowance claimants, but also the approx. 200,000 legacy benefit claimants of Jobseeker’s Allowance. This is not just about ESA, but JSA as well. I notice a lot of the press does not specifically mention the JSA claimants, and it would be very wrong for them to be forgotten again.

      • I don’t think they could get away with that Jeff if a Court Ruling is made it must apply to all legacy Benefits. The Government might appeal against the decision though and cause further delay!

      • and the same goes for entering in to contracts with 3rd party company’s for profit you are not required buy law to sign anything and has been ruled on and the dwp lost in 9 mins and did not even bother to send a presenting officer to defend them self.

        why would anyone sign anything if they are not required to buy law under threats of unlawful sanctions if you dont do as your told.

        this shit will never end and only get worse if you keep being good little profit units to the providers if you want a easy life on benefits you have to earn it and put them work coaches back in there box for good and not let them bully you when in fact they have no power over you at all, the cant check even the job search because of gdpr let alone force you to do anything bar job search and you can provide this anyway you want.

        so in simple terms if you sign the restart programme contract/ data wave they own your ass and they will share your data with 3rd party’s because they are going to use the free funded training courses with esf funding to proved this part of it.

        all you have to do if you are mandated for induction is do it to the letter turn up on time on said date and get proof of postage ie bus fair ect.

        say you are fully willing to participate but will not be giving any paw prints on any contracts or enrollment forms as buy law you are not required to and show the the foi request and smile.

        doing this will mean they will ask you to leave and that means you can not participate and thus stopping you from doing so and not your problem.

        ask for a letter if they do this for there reason why they are stopping you from participating when it is clear buy law you are not required to sign anything and see what comes out the mangle of bs.

        dont forget i was sent for a skills assessment that did not happen so they are not utilising there funding appropriately as it never happened and they dont get paid for this anyway but i needed a conference boosting course instead i have done so many times i have lost count.

  3. I will sign the petition. It’s hard to see how any Judge worth their salt could possibly rule in the Government’s favour on this one. The increase will be welcome to say the least, though it is intended to be a temporary measure it should be permanent, which would take it up to the level that the Council of Europe said it should have been at SEVEN YEARS ago!!!

  4. Does that mean Universal Credit is taken to court yet again. It seem that that is all Universal Credit does is end up in court if you are lucky. The DWP need to sanction their lawyers because the DWP think they are above the law.

    • If you get Sanctioned on JSA don’t you get Hardship payments that roughly amount to about £40 per week instead of the full £74, sometimes referred to as Reduced Rate JSA? If so, then would you still qualify for such payments if you have a Grand in the Bank, or do such Hardship payments depend upon having zilch? If that is the case it might be better to withdraw the £1000 backdated lump sum of “uplift” money from your Bank and stash it somewhere safe or spend it, so that in the event of a Sanction you can still get Hardship.

The last time the DWP had a major judgement against it (when Iain Duncan Smith was introducing workfare) the government of the day, with support from most Labour MPs, passed emergency legislation to overturn the verdict and prevent future similar judgements from happening. It will be interesting, if the DWP lose the case, whether they will do something like this again. If not a couple of million people might be getting a £20 p.e., increase in JSA, until next September anway, and a £1,080 backpayment!

And with a big majority the Tories might try to pull off a repeat as per “uplifting” JSA… unless of course enough “red wall” Tories, with an eye to their future, decide to threaten and rebel as they did when Boris and Co., began trailing their coats about stripping the increment away from Universal Credit recipients.

        The discrimination the DWP has shown between UC and JSA claimants in this case is glaringly obvious and so I’m assuming the DWP will be defeated in court. It will be interesting to see what the government decides to do try to do after the verdict and how many on the Conservative benches decide to do about it.

  10. I have just received in the post my claimant commitment after attending the Jobcentre on Thursday. I noticed that although it shows the starting date as on Thursday this week it then states that this job seekers agreement is treated as made in 2009. I’m now supposed to contact employers every week, look and apply for jobs daily.
    I don’t know the relevance of using 2009 as the starting date for my job seekers agreement.

Even when he goes onto police property, all that happens is he is pushed away gently by the WPC. There are obvious security issues around him filming the cars in their car park.   34. My new claimant commitment states I have to contact employers directly to ask about jobs on a weekly basis.
    It doesn’t say how many a week so I guess I will have to phone up a few employers every week and ask whoever answers the phone. I noticed the claimant commitment looks more nasty. It doesn’t say “may be sanctioned” it says “will be”.

      these things are custom made to how stupid they think you are there expectations mean nothing in law so as long as you apply for jobs and can prove it to stop a ase doubt being raised there screwed.

      Claimant Commitment is not a contract, just a “contractual concept”?

      I can confirm that the Department deliberately did not refer to a legal contract in the previous
      Freedom of Information response. Rather, we referred to a contractual concept because the
      Claimant Commitment is intended to be about a very specific two-way bargain: claimants are
      provided with financial support; and in return for that financial support we expect them to do
      everything that they can to prepare for and find work.

      the reason everyone was sent a new cc is because that is the date they can now sanction you from.

      DWP and DfC should communicate clearly with those whose pre-lockdown claimant commitments have not yet been updated to identify what it is reasonable to expect them to do under their existing claimant commitment.       • The thing people HAVE to remember is that the Claimant Commitment is supposed to be the result of a negotiation between the claimant and work coach about what steps the claimant is willing and able to take in respect to finding a job and what the work coach would like the claimant to do as per the same purpose. Claimants really need to understand this and ask questions BEFORE agreeing to anything because work coaches often try to pressure people to sing up for voluntary programmes and activities, making them sound as if they were compulsory, so before agreeing to ANYTHING it is imperative to find out from the work coach whether they can be refused or not BEFORE you make up your mind.

        People these days really do need to stick up for themselves otherwise they end up shanghaied onto unpaid work experience and workfare schemes, pointless so-called course and all sorts of other activities and schemes which they could have refused if they had wanted to without any fear or sanctions.Once you sign/agree to a Claimant Commitment what is on it is set in stone, without renegotiation with a work coach, and if you transgress the agreement after signing you are liable to be sanctioned as the discretion of the powers that be.

        In a nutshell: Be careful, ask plenty of questions (because although work coaches routinely mislead claimants they most times baulk at telling barefaced lies) and negotiate the best possible Claimant Commitment for yourself before accepting any CC you have doubts about as a binding agreement. If the work coach suggests something, e.g., workfare or a scheme, ask bluntly whether the suggestion is mandatory or voluntary and if it isn’t mandatory and you don’t fancy it simply refuse bluntly on the spot.

        Fight your corner, people, because nobody else is going to do it for you!

    These are penalties when the DWP says someone has failed to stick to the rules of a benefit claim such as by missing a work coach appointment, training course or job interview. Others are for reasons such as being late to sign on for Jobseeker’s Allowance.
