We can only endorse it.

We all know people who’ve suffered from the sanctions-rgime.

It’s time to get rid of it!

The benefit sanctions system is a damaging, expensive failure. Churches, as well as charities, see daily the human cost of this failure in people left without enough money to buy the very basics of life. The recent National Audit Office report has now shown that taxpayers also bear a financial cost for this failure (Report, 30 November). There is no evidence that the UK sanctions regime is cost-effective. In 2015 our report Time to Rethink Benefit Sanctions revealed that each day 100 people unfit for work because of mental health problems received a sanction – mainly for missing appointments with work programme providers.

We have seen the harm these sanctions caused and have met people who were scarred by their experiences. The NAO now tells us that, on average, these sanctions actually reduced people’s short and long-term job prospects and led to reduced earnings for those who subsequently got work. The government has repeatedly stated that sanctions improve employment prospects. The NAO confirmed that the Department for Work and Pensions had no direct evidence for this. Moreover, we now know that the DWP held data that could show whether the sanctions system was working or not. Not only did the department fail to analyse this data, it refused to share it with other researchers. It also discouraged its contractors from assisting these researchers. In effect the DWP appears to have deliberately made itself blind to the failures of the sanctions regime.

As church leaders we are deeply concerned that without proper investigation of the consequences harsh punishments are given to people in already difficult circumstances. We again add our voices to the many government, charity, church and parliamentary bodies calling urgently for a full independent review of the benefit sanctions regime.

    • A number of adverts for that company have appeared on universal jobmatch placed by agencies.Typically they state the location of town locally but is up to twenty miles away to get someone to click into the ad then it becomes clear its miles away.Easily accessible by public transport exe when its shift work is another lie.Its not surprising something like that could happen people are just not going to get to the location without transport.

      Never tell Jobcentre plus you can drive they will turn around and say just that even if a claimant hasn’t got transport means.

      • What a number of these agencies do not mention either is background checks. Here for example asking for national insurance numbers also a credit card or Paypal Account For The Background Check Process (£59.88 inc VAT).

        Also recruitment agencies have adopted the practice of not displaying shift times and that whether or not the post involves working both day and night shifts until the person has registered.

        I suspect they know if the applicant then turned it down after registering that they couldn’t then go get benefit or maintain one for so many weeks.

    If they make a sanction referral against you, act immediately
    Submit a written statement about why you should not be sanctioned
    Insist on a meeting with the manager of the Jobcentre (or the workfare provider) to argue the sanction referral be withdrawn
    If the sanction referral is clearly unjustified, make an official complaint.
    Claim Hardship Payments from the Jobcentre
    Inform Housing Benefit and Council Tax Benefit so these benefits continue
    If your sanction is confirmed ask for a written statement of reasons
    Write to ask for a mandatory reconsideration of the decision by the DWP
    If this fails, appeal against the decision to an independent tribunal
    Seek solidarity from us and others – consider a demo at the Jobcentre or workfare provider if they are not listening to you

      NEWS SEEKER, Came across this while sifting through one of my many data mining operations and thought you may wish to incorporate it based on what you just mentioned if DWP make a referral. In it your notice it refers to claimants providing a reasonable and logical response why something cannot occur and that the work coach must consider whether or not this is indeed reasonable before referral. I say this as claimants NEVER ASK THE WORK COACH, “why is this not reasonable”. You see this could well form a part of your written statement when appealing not only a sanction but also the basis for whether or not the work coach acted appropriately in referring you in the first place.

      I point this as as to often this fact gets ignored in the haste of overturning a sanction. Claimants need when the sanction is reversed to report illegitimate procedure in both work coach and decision maker. The more recorded instances of this will seriously call into question current sanction processes.

    • The DWP definition of ‘last resort’ is not the same as its ordinary meaning which is what the public at large will assume it is… kind of like the way the law in general works. The public at large are going to assume that the DWP has explored all avenues, tried all other options, exhausted all alternative courses of actions, bent over backwards to accommodate the claimant … which as we all know is certainly not the case

    Meanwhile, here is an interesting take on suicide and the role of the DWP in relation to the Suicide Act, from “Vox Political”:

    “The guidance on page 252 of the DWP handbook clearly suggests that anybody likely to commit suicide if they are found fit for work should be found fit for work.

    This is procuring the suicide of another, contrary to section 2(1) of the Suicide Act 1961. This used to state: “A person who aids, abets, counsels or procures the suicide of another, or attempt by another to commit suicide shall be liable on conviction on indictment to imprisonment for a term not exceeding fourteen years.”

    Now it states: “A person (“D”) commits an offence if— (a) D does an act capable of encouraging or assisting the suicide or attempted suicide of another person, and (b) D’s act was intended to encourage or assist suicide or an attempt at suicide.

    The DWP handbook clearly suggests that people who are likely to commit suicide if found fit for work”.

      • @ doug In your usual ham-fisted manner you have not so cleverly conflated the payment of disability benefits and treatment for people who are threatening suicide. People who are threatening to commit suicide should be given appropriate treatment, not just handed disability benefits – no questions asked. Anyone under going assessment for benefits who threatens a HCP (Health Care Professional) with “If you find me fit for work I will commit suicide” should be “sectioned” immediately under the Mental Health Act for their own protection and safety until it is determined what caused them to make such and utterance.

      • I’m afraid that this attitude is the reason the benefit reforms are so pernicious: they are based on the personal convictions and beliefs of inexpert citizens without a shred of substantive evidence to indicate that they work. The Bedroom Tax is an example, which was supposed to “free up” 650,000 under-occupied units of social housing. To mule-headed numbskulls it must have seemed plausible: Cut the Housing Benefit of under-occupiers in social housing and they’d move out – don’t know where – don’t even know if there are sufficient smaller affordable properties to allow them to do so – and the vacant houses can be rented by people with bigger families. Instead of building more social housing the Bedroom Tax was supposed to drive the very poorest and most helpless tenants, many of them in bad health or disabled, out of their homes and suddenly it became a sin to have a spare bedroom even when there was nowhere smaller that you could afford to rent to move to.

        Result: Only about 50,000 of those affected by the Bedroom Tax moved with 92% staying put, either because they had to or didn’t want to move away from their families, friends and support networks, absorbing the cut in their Housing Benefit and having to do even more without as a consequence.

        This IS the story of the Tory benefit reforms.

        FAILURE!

        Same thing with Universal Credit and the carrot and stick. Work and you get to keep some of the money you earn but only 35%, so you might be working all week and only be £40 to £50 better off than you were on benefits and that’s before travel and sundry costs are taken into account. This was the rather small and unappetising carrot that was supposed to “encourage” people to work. However, obviously the powers that be didn’t think that the carrot was sufficient hence the ridiculously harsh sanctions regime which was supposed to beat and browbeat people guilty of the sin of unemployment or under-employment into gainful employment. All for their own good you understand. Trouble is nobody seemed to know what they were supposed to do and when they were supposed to be penalised or what for. People who had never done administrative or clerical work or used a computer suddenly discovered that they had to keep a meticulous record of their “work search” activities and provide evidence that they had spent a minimum of 35 hours “actively seeking work” every week, on their own and unaided, or face a severe sanction as a result. Fragile mentally ill people and people previously considered too unfit for work were exposed to the same harsh treatment which, in far too many cases, worsened underlying medical problems and pushed them into an early grave, sometimes by their own hand. Civil servants who were supposed to help and advise “job seekers” suddenly started being given impossible targets in respect to how many people on their “case load” were supposed to move into work each month and, being human and fallible, many of these people, desperate to keep up their “stats”, began to sanction claimants left, right and centre as the only means they had to try to drive such unfortunates into jobs and score points for themselves with horrendous human costs as a result.

        I don’t think Iain Duncan Smith or Lord David Freud were evil men at the beginning. I believe that these two rather hopeless individuals really thought that the things they planned to do would help the poor and hundreds of thousands out of a rut but the trouble was that both of these men were utterly inadequate to the task and had no comprehension in respect to the ramifications of their actions – a bit like some ordinary person with a first aid certificate gained by attending a one day course attempting open heart surgery – these two had neither the intellect or ability to do the things they desired. The Tory welfare reforms were designed and implemented unscientifically, based on beliefs rather than science, replacing a patchy and clunky social security system with something infinitely worse which has caused enormous suffering, pain and misery to millions and, let’s not gloss over it, the premature deaths of thousands, we may never know how many.

        Iain Duncan Smith and David Freud may have begun with good intentions but their time at the DWP paved a path straight to hell that far too many have been driven down whether the cruelty was intentional or not.

        Both men should be held accountable.

        I currently have a friend with bipolar who is under suicide watch where the Crysis team are involved. Like government said, its complex and its true as these aren’t healthy people but people all to often with an established mental illness. I mention my situation as this person does not claim unemployed/esa/pip benefits but is none the less off work (support worker for people with challenging behavior and learning difficulties) and has a case history of both mental health and attempted suicide. I also help her mother through old age who has a form of dementia.

        So unlike you and sue im not coming from a place of talking out of my hat.

        Im fully aware of what you are both implying but you like government as yet dont seem to have produced evidence of say for example a wheelchair bound person with no mental health issues claiming suicide. Also you nor government have even bothered to have these potential suicide claimants assessed by the NHS mental health department to see if indeed they are suffering a form of mental breakdown.

        So when you,sue and government can produce hard evidence supported by NHS mental health and NOT a private for profit like ATOS or Maximus that the suicide mentioned at such a place or DWP had no case history of current or previous mental health issues, there is absolutely nothing to go on besides your opinion.

      • Why I hold such tools in contempt is I have had two friends commit suicide – one work pressure, one family. A relative has tried and jas serious issues. Another distant didn’t fail.

        So whenever they experience the same kind of thing lets see if they get or deserve help from anybody.

        On a Personal note evidence for hip probs is now showing some 5/10 years after numerous xrays.

      • I subjected myself to the full meeting Andrew and all DWP reps did was try and confuse people by waffling figures yet having to concede to any progression todate coming from looking at evidence abroad while having no evidence nationally to back a single assertion DWP and its various ministers to date have made.

        From what i saw, Government through DWP are desperately trying to ride out the storm while bunging in a untested welfare reform which is obvious when the man mentioned if we did that, it would take ages to bring in the reform. In English this means once we get it in, your be helpless to change it as do remember this is not just a conservative plan but also a lot of members of the labour party too.

        One thing that you won’t see anywhere (Sue, Where art Thou – and from her/his supporters) is the fact that in the building trade workers , only get two 15min breaks, knowing that plus sending them to the furthest site you can imagine how that makes the accident rate spike.

        When im not doing field service or native factory engineering, i work the sites. The reason why what you say is not so obvious is because its masked by the many contractors and subcontractor and this goes all the way to site management. Basically they have there own guys but as work is scarce, they take on way more contracts then they can handle so need agency workers from laborers to skilled workers.

        Now with regard to laborers, mates not directly employed by contractors and subbies, they do get a bit more than 2 15 min breaks but dependent on site size can easily waste 5 to 7 minutes getting toa designated food point as your not allowed to just eat anywhere. Then they need 5 min to queue and clean up before eating, then queue again at the food cabin counter to order some snap and finally wait some 10 mins for there food order to be called out.

        I watched at one site to worst practice of removing asbestos i have ever seen when talking health and safety. While doing it they caused even more health violations by openly standing on ceiling trays (not to be stood on ever as dont support human weight) containing electrical cables, small coolant pipes, steam pipes,plumbing pipes. Just about everything they did was a violation but site management covered it. The health and safety books/records are also doctored so never believe the site safety days boards as its an out and out lie.

        To be honest its not hard to break the health and safety rules on site as (not in the above case) as there an ass so we all get reported for one thing or another BUT that dont mean a thing as unless its a serious breach and or a trip to the hospital, it never makes the infraction books. The scandal is so large i could write a book on it but so its clear, not every worker or contractor,even subby is crooked.

        Its a very complex issue but that’s only so as health and safety does not consult remotely enough with the guys actually working it as we all know how to fix it but then that would mean a lot of health and safety middlemen and organizations losing there profession for ever. Construction sites are among the most dangerous workplace environments there is for someone to work, its a fact of life.

  31. The head of the NHS has urged Theresa May to replace guaranteed rises in pensions with a wider system to help tackle Britain’s social care crisis.

    NHS chief executive Simon Stevens said that the so-called “triple lock” on pensions should give way to a new pledge to help the elderly with their “income, housing and care”.

    “We need to think more broadly about public funding streams for older people, for retirees in this country, and we need to go beyond just thinking about health and social care funding and also think about what’s happening in the benefits system, the pensions system and so forth,” Stevens said.

    “When you look at the experience of other countries, if we are looking for some form of insurance model, it needs to be some form of social insurance model or mandatory long-term care coverage because I think you get market failure in private insurance markets for long term care.

    Now its claimed 1.1 billion was recovered, that 5000 people were prosecuted and 6000 people were sent a administrative penalty.
    From the start i want to point out these 11’000 people would have been prosecuted or sent a administrative penalty for differing amounts so for example one could have been sent a penalty for as little as 20p (HMRC do this all the time so its real and does occur) or prosecuted for sums like £13’000 but not limited to (so higher or lower) for benefit fraud committed over a period of time.

    NOW i want you to put this true fact to one side as i wish you to see something rather odd and telling.

    If we take this sum of 1.1 million and group these 11’000 people and do a bit of division, it implies if equaled that each stung the taxpayer/government out of £100’000 each. As we know these are not the amounts we are seeing in the press so WHAT COULD POSSIBLY EXPLAIN THIS.
    Well even with taking away government errors of 1.9% that’s still around £98’100 per person.
    If we even take away the 11 million benefit fraud SFO busted which was committed by organized crime, its still 97’100 per person.

    So there’s more to this than one mere group of criminals,dwp error and the gaggle of claiming fraudsters. What an how innocent or not so innocent has yet to be reveled.

      You know, I would consider British naivety quite sweet if it wasn’t for the fact, this naivety is positively global. So rapped in self, sporting a pair of rose coloured glasses, the real, real world just passes them by.

From there welfare reform, there business practices, there military decisions, there population control to healthcare, its all FRAUD, FRAUD, FRAUD.

      Of course you cant have them for this as it was you that committed a far worse crime and that was “to look to”, to place your faith in a false idol, to practice idolatry. Had we “looked at”, things would and could have been quite different but all is not lost as awaken you have even if not all the sum parts of the whole.

    Now i read this article doing the usual of taking stock of the facts to add to all the others i have recorded to identify real facts like the staggering amount of pension credit fraud as one example and i came across this rather odd ending paragraph.

    What rehabilitation takes 20 years to complete, does anyone know ?
