Food Banks not just for Christmas but for Life?

with 152 comments

Charity by our Betters.

The Sunday papers continued to carry stories about Food Banks.

In the Observer we heard of,

…a growing row over food poverty, as church leaders and the Labour party accuse ministers of failing to recognise the growing crisis hitting hundreds of thousands of families whose incomes are being squeezed, while food prices soar.

Responding to requests for a meeting from Chris Mould, chairman of theTrussell Trust, which has provided food supplies to more than 500,000 people since April, Duncan Smith has dismissed claims that the problems are linked to welfare reforms and attacked the charity for publicity-seeking. In his most recent response on 22 November, Duncan Smith made clear that he had received enough letters from the trust and referred Mould to his previous answers. His deputy, Lord Freud, the minister for welfare reform, also explicitly rejected an invitation for talks on 30 August, telling the trust’s chairman that he was “unable to take up your offer of a meeting”.

Mould, whose organisation is struggling to keep up with ever-increasing demand for its services, said that he and his army of volunteers could not understand why ministers were refusing to listen to their suggestions for easing the plight of the hundreds of thousands of people in desperate need.

In the Sunday Times the bishop of London showed a worrying trend: Christians and other believers proclaiming their superiority because they help set up Food Banks.

Richard Chartres said,

It takes God’s love to open a food bank.

In the full article (which I read in the library, you can only get an extract on the Net, and, no doubt if you cannot afford food then you’d have difficulty buying the Sunday Times), he ended by asserting that secularists and atheists, in the National Secular Society, had not, to his knowledge, opened a Food Bank.

No doubt as they had not followed the ways of Christ and could not feel, the “particular blessing at Christmas”.

Perhaps distributing food to the poor and hungry, and no doubt washing their feet, is something only the Church can do.

In the absence of a welfare system, where benefits are a right, not something we have to depend on the charity of the faithful to provide.

  2. Having been raised in a Christian fundamentalist sect (I left during my teens and my atheism now makes Richard Dawkins appear positively pious in comparison), the holier-than-thou mentality espoused by those of a religious predisposition is often false, predicated on a desire to please their mythical sky-god(s) and thus purchase their way into heaven/paradise without any genuine empathy for those unfortunates they (as you so aptly term it) proclaim their superiority by assisting. It also needs to be stated that these “good works” frequently amount to little more than covert recruitment drives designed to proselytize their unwitting victims when they’re at a very low ebb (after all, being obliged to use a foodbank through hunger has to be one of the most humiliating, demoralising experiences anyone is likely to face).

On a happier note, the friend who I mentioned in my last posting (he’d been sanctioned for a month) is no longer facing quite such a grim festive period after his estranged sister (obviously suffering pangs of guilt) has stepped in to help him financially and invite him over to her home for Christmas and Boxing Day.

Nobody can purchase or procure their way into heaven by doing good works.

On that point your are in error.

Yes, there is True AND FALSE religion.

  3. END OF THE BEDROOM TAX?

The Morning Star newspaper has a report on today’s front page (Monday 23 December 2013) about another snag in the bedroom tax.

This snag could well be the death knell for the hated bedroom tax. There’s no link to the story in the Morning Star, but a blog has already appeared about it here:

    • I hope you’re right. But don’t count on it as the government has a history of retroactive legislation. I do think everyone who has suffered the bedroom tax should appeal on the grounds that the authority has failed in its duty to properly consider all the relevant regulations.

Pickles is trying to even stop local authorities talking about the “bedroom tax” – it’s now the end of spare room subisdy for idle scroungers (os something similar).

  4. Sadly, its a very serious issue however this made me giggle…

“It takes God’s love to open a food bank.“

Indeed, its the only snippet you need to get the gist of things. I also don’t think its too far off… the reason is myself would never want people to go begging on food donations because they are poor, I would want people to have some income so they can go shopping for food at any supermarket or shop that they wish as a grown-up consumer. The church has a different approach… if you can divide up between deserving and undeserving, raise some cash for spreading concepts derived from a very old book, let those be with sin collect their tins of food and convert them into deserving Christians… hmm… charity should be no-string attached, secular and apolitical for the good of mankind.

Christians have a smelly attitude towards let-me-in-heaven-quick approaches; going from rare breeds Sally Smith Assistant Manager at our beloved YMCA Training Dencora House detention centre that is no more, with intent of bringing people to god in return for basic pointless activities that rarely constitute training just to get money from the Government, all the way to the Salvation Army that are as kind to let homeless people off the streets and feed them as a nice deed at Christmas, only to throw them back on the streets the very next day… not very sporting.

There is so much money in the church that they could easily get the majority of the homeless off the streets in shelters 365 days a year… but of course, that mass shipment of the holy book is more important than people themselves. Of course, no Christian could do wrong. Everyone gets forgiven…

    December 23, 2013 at 3:47 pm

    • If you remember Universal, the Ipswich Evangelicals had a public celebration of giving to the poor (this is why the article in the Sunday Times annoyed me so much).

“People turning out for Pentecost 2013 in Ipswich on Sunday are being asked to bring cans of food and soup with them to help local people struggling to make ends meet.

More than 3,000 people are expected to attend the open-air service taking place at the Ipswich Cornhill, outside the Town Hall from 10:30am.

The donated food items will be given to the Christian charity FIND, which provides emergency assistance to families and individuals affected by poverty or dispossession in the Ipswich area.

John Cobbold, co-organiser of Pentecost 2013 and chief executive of the charity Talitha Koum said: “Pentecost is a great opportunity for people to get together, to sing, to praise God and to show the Church cares for people in the community.

“We are asking people to ‘carry the can’ and bring cans of fruit, vegetables, and our target is to get 2,500 tins to give to FIND to help families in need.

“It would be great if the people who come to Pentecost can help us to provide one can to place into every food gift given out this year.”

Maureen Reynel MBE, founder and director of FIND, said: “I urge people to help, any food that is donated has to be in date and really it is best now if it has a use by date of 2014.

“At the moment we desperately need tinned peas, carrots and sweet corn. Cans of corn beef and tinned pies would also be appreciated.”

The outdoor service will include worship led by the Ipswich Community Gospel Choir and guest speaker, retired bishop Sandy Millar, who founded the national Christian Alpha courses.

Nathan Simmonds, founding member and director of the Ipswich Community Gospel Choir, said: “On behalf of the choir, we are honoured to be a part of such a momentous event. We pray that God will be praised and that the message of good news will be heard and accepted.”

This will now be the third Pentecost festival hosted by the churches of Ipswich and organisers are hoping it will be as successful this year as it was in 2009 and 2010.

Co-organiser Steve Jay, a minister at the Hope Church in Ipswich said: “It is not so much about getting people into church, it’s about getting the church into the community.

“This year’s Pentecost has been focused on helping the community. The two main areas have been the clear the cans clean up in the Queensway area of town and about carrying the can – the appeal for people to provide cans of food for people.” http://www.christiantoday.com/article/christian.festival.helps.local.people.in.need/32450.htm

The DWP has now explicitly confirmed it does share your personal data with it’s Welfare to Work Providers and others. But do remember you can still complete Withhold or Withdraw Consent, preventing how Providers share your personal data. Plus more often than not there is no need to sign any Providers forms giving them permission to collect and share your data, under the #DoNotSign principle

  7. Complain about Jobcentre Plus.

Contact the Jobcentre Plus office you’ve been dealing with if you’re unhappy with the service you’ve received – their details will be at the top of any letters from Jobcentre Plus.

If you’re unhappy with the response:

You’ll be asked if you want your complaint sent to the Director General of Operations for the Department for Work and Pensions. They aim to deal with complaints within 15 working days.

If you’re still unhappy, you can then ask the Independent Case Examiner to investigate – they’ll be impartial and this is free.

If you’re unhappy with the response from the Independent Case Examiner, you can ask your MP to send your complaint to the Parliamentary and Health Service Ombudsman.

    • It wont make any difference. They will only address the parts of the issues they want to. ie well its solved now or its policy or simply just answer the questions they want to answer even if its not the one you asked. They ignore all other evidence that disputes this , you are not contacted in the investigation for any information or proof nor will they ask for any recording you have,

Any so called Investigation is carried out by the section you are complaining about and the complaints resolution team has no authority to carry out the investigation nor the will to do so.

You will receive a boiler plate letter stating thank you very much your complaint has been looked into and there are no grounds etc you got good quality service. You certainly wont get a detailed response to each point you complain about which you are entitled to by their own policy if you ask for it. At this point they will just close it stating if your not happy take it up with ICE

If you are persistent they will refuse to talk to about the matter at all citing their policy on nuisance calls etc

ICE will then take a year to pretty much rubber stamp the DWPS response laving with the option of court action which they know you cant afford.

I have been all through this in the, last 2 years and still not had any detailed answers to the issues raised in my complaints even though I have members of Wigan JC lying on recording on tape on numerous occasions. For which they WILL THREATEN to have you arrested.

once I have finished transcribing the recordings and had the the transcriptions independently verified I will publish the recordings including the names and dates of those staff members

The DWP can complain to ice all they want (another one of there threats) . I Look forward to being taken to court over the issue or by those staff members

        December 26, 2013 at 10:29 am

      • Take a step back and think about this MBXK454.

WHY DO YOU THINK THEIRS A NEED FOR AN ACCESS BUTTON IN THE FIRST PLACE ?

Its because we all have a right to privacy (human rights act article 8) and in connection with the data protection act in that the data subject (you) has a right to control the flow of their said personal and or sensitive data.

These are both LAWS that have to be obeyed, even by governments unless of course you break the law be it criminal.

NO ONE PERIOD CAN FORCE YOU TO NOT ENACT THESE LAWS THAT ARE THEIR TO PROTECT YOU AND ALL OF US.

Ingeus like DWP are subject to the same rules so NO, UNDER LAW UNLESS YOU GIVE THEM YOUR PERMISSION AND THIS CAN BE RETRACTED IN WRITING AT ANY TIME AFTER THE FACT, THEY CANNOT, I REPEAT CANNOT EVEN UNDER MANDATE, ORDER YOU TO SURRENDER ACCESS, CANT EDIT YOUR DATA WITHOUT YOUR PRIOR PERMISSION AND FINALLY CANNOT ORDER YOU NOT TO CHANGE YOUR OWN PROFILE AND OR CV.

I know Ingeus very well so believe me when I say they CANNOT ENFORCE THIS, YOU CANNOT BE MANDATED,DIRECTED OR SANCTIONED FOR OBSERVING YOUR RIGHTS UNDER LAW, IT IS BOTH REASONABLE AND LEGALLY JUST.

I have to ask did you even ask them to demonstrate under law where it states they have a right to mandate this as I suspect its nothing more than a jobseekers direction in which case BYE BYE MANDATE.

Heres links to both laws, print them out and take them in.

DATA PROTECTION ACT (first link breaks it down in layman, the second is the actual law your need to take to this interview).

        http://www.yourrights.org.uk/yourrights/the-right-to-know/data-protection-act/index.html

        http://www.legislation.gov.uk/ukpga/1998/29/contents

HUMAN RIGHTS ACT article 8 (again the first is layman, the second the actual law you need to take with you).

        http://www.yourrights.org.uk/yourrights/privacy/index.html

        http://www.legislation.gov.uk/ukpga/1998/42/contents

(Schedule 1 is the articles but do read the entire act).

In parting as god is my witness I myself do use both, primarily DPA and todate have enforced this on both Ingeus and DWP and DO NOT despite their several failed attempts have a UJM account as ive already demonstrated I already us UJ quite effectively already.

Just REMEMBER that Ingeus is contracted to government so must act as government do meaning they can only mandate with just cause, you to open a gateway account and provide evidence of this fact (doesn’t include giving account names or any details that are deemed under law as personal and or sensitive data) so take a print out and with a BLACK MARKER COVER THIS DATA then the jobs done.

Also remember your free to refuse cookies even on someone elses system as under the regulation they must seek your consent whether they like it or not

        http://www.aboutcookies.org/default.aspx?page=3

        http://www.legislation.gov.uk/uksi/2011/1208/made

Scroll to regulation 6 (that’s the one without these brackets ()) and look at subsection (3)

Last but not least YOUR FREE TO OPEN AND CLOSE YOUR ACCOUNTS ANYTIME YOU LIKE (CANCELLING MUST BE DONE IN WRITING BUT DOES NOT PROHIBIT YOU STOPPING USING IT OR DECLARING NON OWNERSHIP IT WHILE ITS WAITING TO BE RECEIVED,consult UJM site rules for cancellation of account). If you think about this last piece and use it correctly, you could make Ingeus wish they never tried it on or ignore what I just said and go for the upper above quite, done and dusted approach.

  19. THAT’S ODD

Listen carefully. A new mental illness is around called Oppositional Defiant Disorder – or ODD for short!!

ODD is defined as: “Ongoing pattern of disobedient, hostile and defiant behaviour”.

Symptoms include, questioning authority, negativity, defiance, argumentativeness, and being easily annoyed”.

Looks as though most thinking members of the population are now suffering from this new disease!

      http://www.dailymail.co.uk/news/article-2529714/Duncan-Smith-No-hiding-place-opt-life-benefits.html

Interestingly, the Great Train Robbers were given 30 years for stealing a few million from the Government (41 Million in today’s money), but remind me, how much money has IDS wasted already on his welfare reforms?

I wonder how many years I’ll get in the Gulag or mental hospital for daring to say that?

      • ”Tobanem”. A few years ago there was a political party called the CORRECTIVE PARTY. The person who was running it had some very good ideas. Unfortunately for certain reasons she gave up on it. Have you thought of running for parliament as an independent. Depending on your area, I am sure you would get plenty of supporters. If the elected you could speak with out fear of the Gulag Or Mental Hospital under the privileges accorded to a Member of Parliament ?. I would vote for Andrew Coates too should he decide that hew was standing in an election.

Although MPs are privileged in speech, I think a lot of them could well be described as Mental Patients (MPs!) when you consider some of today’s politics of the madhouse!

Note, The mental condition “ODD” described above, comes from America, where it strictly applies only to children. That is the position today, but with a simple modification…well, it could easily result in incarceration for outspoken adults in this country tomorrow!

  22. Local councils ”exploiting” back to work scheme to fill roles left empty due to Coalition cuts

Town halls are increasingly taking on workers under the workfare programme to fill roles left empty because of cuts.

But figures show that the majority of the jobseekers are only given work for a few weeks and do not get a permanent job at the end.

The scheme has been branded a “disgrace” as participants only receive their benefits – meaning they get paid as little as £1.78 a hour for a full time job.

“Research shows workfare doesn’t help people find work. People across the country are taking action to stop Osborne’s new six month workfare scheme from launching in April. Forced unpaid work cannot become the norm in the UK.”

  23. For Obi Wan Kenobi

    Are you a fool?

“The fool has said in his heart, there is no God”

You should have said you don’t personally believe in God in your own opinion, because you don’t have Faith.

Saying there is no God takes a monumental level of foolishness, and only serves to demonstrate the natural lost and FROWARD state of man, a state which makes it impossible for an unconverted person – like yourself – to believe in God.

You’re quite right I personally don’t believe in god.

But consider this, The Big Bang was (as we understand it) the start of ‘our universe’ and (as we understand it) there was no time (no nothing) before that event. If there was no time before that event – how could god exist in the first place to make The Big Bang happen?

“The fool has said in his heart, there is no God”

That quote was written by the people who created the orders of ‘Religion’, this is mearly a control mechanism for the weak minded who ‘Have’ to believe in something.

Religion – the biggest ‘Con’ in history!

      Obi Wan Kenobi

      December 29, 2013 at 9:49 am

      • Careful Obi Wan Kenobi

Get rid of the Jehovahs? Although Jehovah’s Witnesses are a false cult, they were in fact persecuted by the Nazis as “BIBLFORSCHER” in concentration camps, along with the ARBEITSSCHEU, or workshy – the long-term unemployed. Is that what you want?

No one is going to tell me that some time after a theoretical big bang – which just happened out of nothing in the first place – there was a random bolt of lightning which then reacted with some steamy ammonia (which just happened to be there), and the result was The Creation with all its ordered times and seasons which are subsequently maintained merely by some Godless chance!

God is eternal. He was not created at some point in time – like all the elements and ultimately, man.

These things are a matter of Faith. If you are given the gift of Faith, you believe in God; if you do not have the gift of Faith, it is impossible for you to discern the things of God, because the things of God are SPIRITUALLY discerned.

Remember, God will destroy the wisdom of the world and bring to nought the understanding of the (worldly) prudent.

I can think of nothing more futile than someone, like yourself, standing before Almighty God at The Day of Judgement, trying to tell God that He (God) does not exist!

But that, again, is a matter of Faith.

Oh, and don’t forget, God is against using workers without wages!

        Praise God!!

  29. Now for something juicier.

Today mentioned in the press was a change to the libel law and the reason I bring it up as I can see exactly how the likes of IDS would abuse this what with all his comments being mere opinions rather than fact.

    http://www.legislation.gov.uk/ukpga/2013/26/contents/enacted

Weighing libel on the strength of stress and damage caused, pure genius and all would be wise to remember this as libel isn’t the only law that measures recourse via damage and stress caused or liable to be.

So that’s yet another law changed where the level of determines whether or not it will ever see the light of a court room or compensation. Theirs many exterior angles to this but one I feel that will tap into it will be no doubt the so called peer reviewed data surrounding fracking not to mention wind and PV who regularly feed bad data to the public so as to secure a lucrative deal and heaven help us if politicians resurrect human CO2 global climate change as it will not be the businesses paying to pollute, it will be the likes of you and me when they pass on the costs.

Like I said in the past, our benefit cheques are the least of our worries and working wont change this a bit as our public debt grows to levels never experienced in this country before.

Heres a documentary published by moneyweek, the well established financial advice paper that predicted the global crash ahead of time. Make of it what you will

    • So its blame the working man and the sick and the elderly for wanting more and causing national debt, How about our politicians for selling off all our assets and squandering the money?

OR chasing all that missing tax from companies I’m sure that collecting most of that for 10 or 15 years would reduce the debt by large chunk.

Sorry old boy I forgot we cant do that or else our friends / family in those companies would not reward us with directorships and we would actually have to go into parliament and do some work.

Why do I need a government to take money off me if it dosnt provide any services for me ? When the mafia do it they dont call it tax but extortion.

      growls

      December 31, 2013 at 1:08 pm

      • You make it sound so simple growls and I truly wish it was as easy as balancing my bank account but that’s not to say some of your comments aren’t without merit like government wastage for instance but even reducing that to zero wont still touch the sides of our current national debt.

The Tories or capitalists if you like are trading off the premise of spend to speculate and IF it works out will come as relief to us all BUT IF it doesn’t as its a humongous gamble never witnessed before will consign the tories to the dog house for decades. I could even say that never again would a tory ever think to blame labour let alone a cat as no party wants to be known for a record breaking unprecedented disaster.

The question that this moneyweek is putting to the audience is when exactly do you want to pay the price as we have been in debt since the 17th century but never have we witnessed the levels we see today. I personally wouldn’t fear you like the above video as its not to late to lower the fallout but mark my words or that of better people that if left unchecked and fails, what they state will be the exact fallout you can expect although I would predict a longer recovery from such.

All of this I do indeed love chatting about but would be trolled to death as well, this sites about unemployment so I will end it their but none the less am quite thankful for the reply growls as far to many people don’t like talking about this, especially politicians.

Oh, I forgot, it’s all about anti-terrorism, so if you’ve got nothing to hide, you’ve got nothing to fear – and the police only deal with bad people.

    • Ok Growls, I digested your FOI and to be honest their reply is what I would expect them to supply and for the record they didn’t have to as the information is already available.

You can complain to ICO but it will do you no good as DWP are correct im afraid. This said I will flesh it out a bit for you.

The question of recording is considered the processing of information so is covered as advertised under the data protection act so you really need to grasp this law or more importantly the 8 principles.

For a start no one likes someone who cries its my right while thrusting a lens in their face.

Secondly recording an interview and recording in a public place is two different things as is whether or not audio is involved. Also you appear to not get when and when not consent is required.

Despite signs of NO mobile phone and recording being present its not an enforceable law but a request. This said DWP are full within their rights to terminate an interview BUT this cannot be used against you, it simply suspends that occasion you attend.

Stop with this public place argument as even though it is IF it contains a audio recording you do have to seek consent first so allow me to help you bypass this consent business.

Firstly conceal your recording so if a mobile use a jacket with a front pocket, cut a small section away from it and place onesided material in its place. Then place your phone in the pocket. NOW NOT UNDER ANY CIRCUMSTANCE ANNOUNCE YOU ARE RECORDING.

One point of the 8 principles is as follows.

1: Data cannot be released to a third party without the consent of the individual it refers to, unless there is a lawful reason to do so – for instance, the prevention or detection of criminal activity.

As you can see if you can catch them in a criminal act (ie, FRAUD), they NEGATE THEIR RIGHTS UNDER THE DATA PROTECTION ACT and thus brings the recording into play without prior consent.

Well I hope this helps Growl

      January 4, 2014 at 12:41 pm

      • Thanks for taking the time to reply , however I think your are wrong, consent isnt needed when one party is aware the conversation is being recording.

In addition A court of law may also decide to hear this evidence despite the restrictions placed upon private use by the data protection act if the courts deems so fit.

Secondly a private citizen may have the right to refuse to be recorded and walk away.

However the DWP have a legal obligation to provide you that service also the only authority the staff have is proxied to them by the secretary of state. They can not claim to be acting as a proxy for the Secretary’s authority and insist on being a private individual . Simply because a private individual does not have the authority legally to issue sanctions etc.

Otherwise they could simply deny you your legal right to record and also the service they are bound by law to provide simply by refusing to be recorded enmasse.

The issues are contrary to their own stated polices they refused to provide a ‘private ‘room

In addition it clearly stated in the response in regards to the cameras in the Jobcentre MY consent was clearly asked for and obtained. This is a false hood intended to mislead.

They Deliberately evaded my question of where and how this consent was obtained and I am willing to make a sworn statement in front of a judge that this consent was never given.

The question was clearly stated and as where and how by what mechanism was that consent obtained not how to obtain access to video footage

They also knowingly tried to evade the questions asked by providing information that had no relevance to the issues raised. I was not and am not a party to the persons contract of employment that is a matter for them and the DWP . Nor did I request that information.

They also state their is no policy in regards to that issue yet a decision has clearly been made , There are cctv cameras and recordings are used to support the DWP in event of legal action. Therefore someone decided to implement them and they have to be switched on.

The issue was who decided this and under what authority , Parliament / legislation , the DWP’S or the secretary of state, this was implemented once again they evaded the issue and answered with completely spurious information.

In regards to employment contracts I am not bound by the terms and conditions of that contract , DWP staff are legal bound to provide the service which is my legal right.

They also stated no policy was in place for a hyperthetical question. They themselves introduced the personal ‘information’ part as I merely pointed out I had evidence that this behaviour did in fact happen I did not however ask for Any information regarding to that incident , why should I ? I all ready have the recordings of several incidents they claim would never happen.

It may well be their is no official policy in place but the qquestion asked still remains valid under what authority did they act as they are claiming they havent acted yet the cameras exist and have clearly been utilised.

In addition people should be aware Should you wish to exercise your right to view that footage you have to contact the private security firm to obtain it who unless requested by the DWP to retain it destroy it after seven days so you have very little chance to obtain it should you wish to use it to support your case in event of an incident.

Let me guess the DWP declared them Data controllers also?

There are very few issues that actually touch on the Data protection act in this matter

Sorry for the long reply folks.

      • Before we begin I seem to remember your FOI and remember you were going into hospital weren’t you back then? , If im correct, how are feeling these days regarding your health and did it go ok ?

Ok, I will start speaking now but do remember at all times AS I MAY SAY THINGS YOU DONT LIKE OR DONT WANT TO HEAR BUT AT ALL TIMES IM ON YOUR SIDE.

First off we all know DWP lie and will avoid having to comply so lets move that out of the equation for a start as it only serves to muddy the situation/s to which we speak of.

I have not now or ever gave a fig for what DWP or any government/dept, business or person of such say. When I give out data here on this site I use the law while being REASONABLE,LOGICAL AND PRAGMATIC when giving advice in connection to a claimants personal issue.

I will do my best to be concise as possible with the law but please do understand its not an easy subject to discuss lightly especially when talking the myriad of laws this matter involves. This said I will try and use the least amount possible to explain and expand on some points I made in my earlier post.

        FOI REQUESTS

The reason I stated it is what I would expect them to reply is because of the following.

FOI like DPA has exemptions and here are 2 that confirm what I meant when I posted a reply as regards your questions to them

1: Information that is accessible by other means (I found all the answers to your questions online and in open documentation).
2: Information relating to or dealing with security matters.

SECURITY CAMERAS AND RELATED DPA EXEMPTIONS AND YOUR RIGHT TO NOT BE RECORDED

DPA part 4 (29)(1(a) Crime and taxation

        (1) Personal data processed for any of the following purposes—

        (a) the prevention or detection of crime

So they DO NOT need YOUR consent when considering CCTV surveillance providing they conform to the DPA in respect to signage, storage, usage, retention and destruction.

Unless they FAIL to display signage THEY HAVE IN ACCORDANCE WITH THE LAW CLEARLY ADVERTISED THEIR INTENT TO RECORD SO IT IS UP TO YOU TO OBJECT, NOT THEM TO ASK YOU EVERYTIME YOU COME IN and this ONLY APPLIES WHILE YOU ARE BEING INTERVIEWED AND NOT BEFORE OR AFTER.

If you DO NOT voice your objection IT IS READ AS LEGALLY GIVING YOUR CONSENT. As a result if you do they MUST MAKE AVAILABLE A PRIVATE AREA TO WHICH YOU DO CONSENT HENCE THE INTERVIEW ROOMS BUT THEY MUST NOT CONTAIN CCTV OR IT IS THE SAME AS UNLESS IT IS SWITCHED OFF AND CLEARLY MARKED/DEMONSTRATED AS SUCH (ie NO RED LIGHT,etc).

(AT THIS POINT PLEASE DO REMEMBER A JUDGE WILL VIEW CCTV WITH NO AUDIO DIFFERENTLY TO CCTV WITH AUDIO IRRESPECTIVE OF THE DEFINITION OF PERSONAL AND OR SENSITIVE DATA THEIR BY DECLARED UNDER THE DATA PROTECTION ACT). I state this as all laws have grey areas, are contractive to some other laws and are all full of loopholes so what im saying is law isn’t really perfect and or absolute hence the need for judge/unbiased authority/overviewer where an impasse exists.

Two people using the law is like dare I say it POKER where not clear cut. Luckily DWP in my experience are crap at it hence their need to distance a claimants chances or will to pursue it by carrying on with the bet in the hope of a successful bluff. This said though many a claimant is often misinformed or ill equipped in the use of the law and so loses anyway even after going full term. This is why appropriate legal advice and or deep research is strongly advised before issuing a formal compliant dew to the time constraints once initiated.

        YOU QUOTED

“consent isnt needed when one party is aware the conversation is being recording”.

“In addition A court of law may also decide to hear this evidence despite the restrictions placed upon private use by the data protection act if the courts deems so fit”.

Like I said with regards to the 8 principles (This is law period)

“1: Data cannot be released to a third party without the consent of the individual it refers to, unless there is a lawful reason to do so – for instance, the prevention or detection of criminal activity.

There are other exemptions too but the above is why often a judge will entertain such.To coin a phrase, how does the abused spouse prove abuse?

That’s all for now but I will pick it up again later on to continue to address your points when ive had some sleep and had my run in so stay well and warm and post you later.

It was openly declared that a recording was to be made that stated EVERY conversation or interaction ( including signing on ) with the DWP or any of their agents (work providers) etc in ANY media in ANY format written, oral , phone call etc would be recorded and used as evidence in any further proceedings subject to the courts will without further notification.

It also informed them they had 28 days to respond in writing acknowledging this fact or detail the alternative arrangements to provide me with the services I am legally entitled to (ie a private room ).

The 28 days expired without a reply. I however still have the letter , the receipt and the recording.

It is my understanding as a none legal professional that it is also valid to transcribe the recordings and submit them to hearings etc as evidence. It is then up to the DWP to dispute the validity of the transcript * and the original recording may then be used to to determine the issue.

*other wise how can the dwp submit their version of events via the ‘notes’ taken.

    • I have posted this before but here it is again. You do not have to give them copies of your job search, just tell them and let them write it down. This takes up too much of their time and they will stop doing it.

      Universal Jobmatch Toolkit

Chapter 3, Paragraph 82, it states quite clearly:

We cannot specify to a JSA claimant how they provide us with records of
their jobsearch activity and Universal Jobmatch will not change this – it is not
therefore possible to require JSA claimants to give DWP access to their
      Universal Jobmatch account.

      http://www.whatdotheyknow.com/request/174779/re…%20Response.pdf.html

      Paragraph 89 – it says:

the onus is on the claimant to provide evidence of their jobsearch activity (by whatever means they choose).

      From LMCG:
      188. The JSA Regulations do not specify that claimants must keep written records of their job search.
      http://www.whatdotheyknow.com/request/169272/re…ach/3/FOI%203354.pdf

Right I know I said I would pick that post up again but if you don’t mind can I delay it for a day or two as today has been quite eventful and ive got a few interviews tomorrow and Wednesday so want an early night so as to be fresh not to mention their all 3 hr like journeys but that’s ok as I prefer to work away from home so six hour travel for the sake of a job is a small price to pay.

Anyway unless you would rather I stop I promise I will bring this matter up with you again as I would like to see you get justice too and would imagine all on this site wouldn’t mind you scoring a victory either. In the mean time though if you have evidence of deceit then they automatically forfeit their rights under DPA so yes is officially usable as you say.

The way I see it anyway is like you all claimants should record their interviews so good on you growls for being a warrior, a true man not afraid of consequence and to think your doing it despite being of ill health. • Hi again Growls

“However the DWP have a legal obligation to provide you that service also the only authority the staff have is proxied to them by the secretary of state. They can not claim to be acting as a proxy for the Secretary’s authority and insist on being a private individual . Otherwise they could simply deny you your legal right to record and also the service they are bound by law to provide simply by refusing to be recorded enmasse”.

Your quite right, an individual shouldn’t be able to play both sides of the fence and this is why they cant completely rule out your right to record an interview so instead first attack any ignorance the claimant may have (DONT TELL A CLAIMANT ANYTHING THEY DONT ALREADY KNOW), next stall for time hoping claimant will rescind the need to record so as to gain payment ontime and inbetween try to enrage the claimant so as to CLAIM ABUSE yet will all to often FAIL to sight the actual nature of the offence by citing DWP policy.

By sticking to ones guns as you did, they know their have to complete it.

        Another quote by yourself

“In regards to employment contracts I am not bound by the terms and conditions of that contract , DWP staff are legal bound to provide the service which is my legal right”.

If your referring to your JOBSEEKER AGREEMENT, and this use to be printed on it back in the day, is NOT a legally binding contract and as such not subject to contract law.

I suspect you wont find any easy explanation at hand online (do look though as you never know) but a study of the law itself will make apparent the pitfalls when considering what is and whats not.

I know, I know, that’s not an answer but in earnest its been a few years since I last looked at this but none the less at the time couldn’t find grounds to classify it as such myself and I believe but don’t quote me but no one todate in a court of law has had it declared as such.

On your point about about Jobseekers agreements if this is a contract as they claim between you and the DWP member then they have to be acting as an agent of the secretary of state otherwise there is NO requirement to make a contract with a private citizen in the JSA statutory legislation to make a claim.

    would apply http://www.thompsons.law.co.uk/ltext/116-admissable-evidence.htm

“It then looked at the school’s objections to the evidence and completely rejected the notion that the governors’ human rights would be violated. The case had no bearing on their family life and could not, therefore, have any impact on it. And as they worked in the public domain as governors, their private life could not be violated. ”

Dwp staff clearly have to function the public domain otherwise they have no more authority than you or I to apply benefit decisions .

  59. This Government is the worst one I have ever know of. It has put many people in poverty. The unemployed ,disabled and the low pay worker has had enough now. Something should be done to enable people to make ends meet. It was the greedy bankers and the rich that put the economy in such a state but the poor are the ones who are paying. They are having a terrible time living in this country and not one politician cares. This Government is a complete waste of time and space. It is to be hoped that they do not get in power again

  60. People are being robbed by this Government. How can a person make ends meet with a Government like this one always putting down the poor and treating them like shit. As well as keeping then very short of vital money that they need to live on. I do not believe there is a future in this country. Capitalism does not work for all only the rich. Where do we go from here? Only the Bums and dead legs in this shambles of a Government knows that. Jobcentre plus is a corrupt organisation they take great pleasure in sanctioning benefits and making claimants suffer and starve. They do not care because they are o k there not starving. Corruption The rich put us in this mess and the poor have to get them out. This is at the expense of the poor going hungry. That’s what is not fare. Look at the MPs expenses when they were fiddling every penny they could.

  61. I’ve been reading as many posts as possible off and on as much as I can for quite a while now. I wonder if it is possible with the vast amount of interest on this site and related sites that someone could compile a list of things to do and not to do when we are confronted in the many lies and half-truths that we have to deal with on a daily bases when we are sat in front of job centre staff and advisers. Just knowing I have all the latest information as from 2014 at hand helps even if it’s printed off in my folder or have it to hand. I have found this to be of major help when it comes to fortnightly, weekly and daily visits to the jobcentre. I have spent much time watching many people come and go with nothing to rely on at the very time it’s needed, walking into a job centre with nothing more than a torrent of questions and thoughts running through their head. Every visit leaves people with only one thing and that is to give into the fear these job centre employees think they can dish out on a minute by minute basis. You see that folder I was talking about helped me a whole lot and still does today. I take my folder every time not only does it have my job search activity in it with printed emails I have sent off, it has the basic information I have collected on my journey through the DWP world so far which helped me big time. I say this with a sad heart knowing the four or five people that go up to their advisers and other staff members and are getting a beating pretty much every time not all but enough to piss me off. Going into such a place with nothing at all accept with what’s running around in your head is not good. Hearing job centre staff tell the weak and vulnerable they want access to universal job match and why they have not completed their job search correctly and next time a sanction will be coming their way soon. The vast majority of claimants do not know and have no idea that just by unticking those two boxes could do so much to block the fear process when you have to visit that place. Then your battle is half complete. When that happens I think it would be nice to see a list that can be added to a weekly or monthly update, in one area without having to search the entire internet, which I did myself when I first started to realise this shit has got to stop. Just like advertisements they repeat, repeat, repeat-is the key here. Now whenever I attend any course that comes my way when the chance arises I am flat out telling people on the course and staff members of everything I now know. I am so shocked that these people don’t know anything about their circumstances. I had a room of 20 people plus staff listen to me for 45 minutes solid, scared the shit out of me. I once read that you cannot be told the truth you have to learn it yourself. Some people just don’t want to be woken up and that scares me the most that’s why I am asking for your knowledge on this matter to simplify things that at some point are really going to matter the most for people who need it all so they can print it off quickly Just one more thought after many months searching the net the one place I thought I would see more information or here more is YouTube and yet very little WHY IS THAT??
