The Department for Work and Pensions has declared this week an apparent celebration of the sanctions imposed on the unemployed.

While the so-called conditionality week appears to have been scaled down, across the UK jobcentre staff are still being asked to take part in events including quizzes using offensive anagrams, offering financial rewards for staff and there are dedicated sessions looking at how to impose tougher sanctions on claimants.

We are outraged by the DWP decision to run such a week, ‘celebrating how far we have come since the introduction of tougher sanction levels last year’, according to the department’s headline news page.

At best, this is poor taste, at worst these are cynical actions intended to pressurise staff to make sanction referrals and to normalise the impact that sanctioning has on claimants and their families.

We are shocked that the DWP would think the concept of a celebratory conditionality week is acceptable, especially given media reports of the rise in the number of families using foodbanks and in some cases claimants self-harming because sanctioning. We are also very concerned that even harsher changes to welfare programmes are being announced at the Conservative party conference this week.

Real routes out of poverty

We believe the government needs to invest in more staff to deliver a more holistic public employment service. PCS has long campaigned for a welfare system that gives people the support they are entitled to and offers real routes out of poverty.

    • Scenario 2 (the real reason):

      The job centre can’t be arsed to send out the appointment letters in the first place. The first time you hear anything is when the brown envelope hits the mat telling telling you that you missed a scheduled appointment and need to call and tell them a valid reason why. You call to tell them, then get an earful of the first few bars of Vivaldi’s 4 seasons on a continuous loop for half an hour before you get a half retarded human (?) voice. Not receiving the initial letter is not a valid explanation, nor is being in hospital – pass to the decision maker at the benefit delivery centre for a sanction doubt.

      2 of these letters I’ve had in as many months. The first time I got sanctioned I went to the JC and the manager handed me a ‘copy’ of the original letter in a sealed envelope. Was there any need to seal it in an envelope just for me to open it in the next room?? There’s nothing confidential in there that the JC don’t know about. That’s what makes me think they’re not getting posted. All my other post is arriving on time so maybe the postman is allergic to DWP mail. I think not!

      The same thing happened with the WP, except the dates on their letters were always later than what they had in their diary, the only difference is that they used to hand a signed letter out before you left the building so you had proof that it was their error. (They had people doing MWA at the reception desk so may explain it)

      I’ve never been told when my next appointment is at the JC, I’m on ESA so they just say it will be posted to me. I may have excessive electrical activity in my brain (epilepsy) but that doesn’t make me telepathic!

    Is this real?

    If so, it is not too far away from what happened recently in China, where a pregnant woman was violently arrested at 4am, then taken to “the people’s hospital”, and forced to have an abortion by injection with the aborted foetus subsequently dumped in a bucket at her bedside.

      • I HAVE THE MEDICAL CONDITION NEUROFIBROMATOSIS. THIS IS MENTIONED ON THE DWP WEBSITE AS A SIGNIFICANT DISABILITY. HOWEVER DESPITE THE PROBLEMS IT CAUSES AND WILL CAUSE IN THE FUTURE ATOS AND JCP SAY I AM FIT. THE CONDITION IT’S SELF REQUIRES TO BE DECLARED FOR EMPLOYMENT LIABILITY PURPOSES. I HAVE HAD WORK RELATED ACCIDENTS IN THE PAST BECAUSE OF THIS AND IT HAS COST ME JOBS AND PROBABLY GOT ME BLACKLISTED TOO.       • DWP have changed the points system over the last year or so too, making it more difficult to get ESA. Particularly where neurological conditions are concerned, illnesses are not always visible so as far as ATOS are concerned they don’t exist unless you can’t climb the four flights of stairs to their insulting rooms. (They try not to use lifts and they watch you on CCTV from the moment you set foot near the building)

        To give an idea, I had an epileptic seizure in their waiting room while waiting to be seen. I was ill at work in October 2010, diagnosed with epilepsy about 6 weeks later. Their consultant insisted that I should try and do the medical which would take no more than 20 mins – which I did. The report came back saying that I showed no signs of neurological illness despite them witnessing me brake dancing round the floor half an hour earlier.

        They even had a new section on the back page of the ESA50 form which I filled in a few months ago which asks the GP of cancer sufferers and those who are dying for an estimate on how long they have left to live. Sort of like an ‘abuse by date’ for DWP.

      • I believe “a police officer” is really a previous contributor to this forum called Wayne. He has been involved in spat with other contributors on this site for some time now.

        In one posting someone wanted to know where Wayne was and Andrew Coates quipped that “Wayne was last seen outside a Thai restaurant looking hungry”. Hence the anti-immigrant/racist comments in a “police officer’s” postings.

The government says it works over there, so it will work here. Well of course it works for the Americans. But they overlook one inconvenient fact; this isn’t America, and it never will be.   15. At my last signing on I was asked in a nasty way why I wasn’t volunteering. I wish I’d had the gumption to tell the up her self little madam ‘that if the government hadn’t stolen my pension for 3 years I would have time to volunteer instead of which I am desperately trying to find work so I don’t have to spend hours logging on to NastyGits.com trying to find work not to mention looking on useful job sites and desperatly trying to find a job so I don’t have to see her smug face and she should be grateful for people like myself who keep her in a job! I would be happy to do charity work’ unfotunately I can’t afford to be sanctioned.

  17. Its time for a claimants union I think, its one thing to lie to the individual but quite another to lie to 1.58 million at once. The public have a right to keep a record and DWP cant stop you, especially with the weak argument of protecting others personal and or sensitive data who actually they are bound to under law and NOT THE CLAIMANT RECORDING THEIR OWN MEETING.

    You see DPA only takes effect after you enter personal and or sensitive data via an agreement so anything said or produced after requires a new agreement even if its repeated. This means the claimant has volunteered to verbally part with this personal and or sensitive data prior to any agreement and thus doesn’t come under the DPA law. However any advisor or DWP employee parting with another’s personal and or sensitive data is subject to law and considering we don’t sit in separate rooms during signing on means that it is them that will be caught breaching the DPA and not the claimant recording their own meeting who has entered into no such agreements with other claimants and thus making it all perfectly legal from a claimants point of view.

    DWP don’t have to scream your name out, don’t have to ask for details verbally, they chose to of their own free will when they could get a claimant to take a ticket like they do at the post office when arriving and write it down instead when at the advisors desk. So clearly they don’t take DPA that seriously or even practice it effectively.

    On average I could cite DWP for at least 10 DPA breaches every visit so it gives you an idea of how much they breach in a day, a week, a year when you factor in total claimants per week.

    If every claimant recorded their interview with DWP, they would have already had them banged to rights for instance lying about UJ inorder to get people to sign up not to mention asking for data clearly their not entitled to such as email addresses for instance.

    The best weapon is us all joined to the hip not to mention the papers will love to write about claimants forming a union so will lap up the stones we over turn on DWP practices that IDS denies occurs. The more we confront the advisor the more they will mention management and management inturn will mention HQ to eventually we get to the ring leader himself IDS, pants down, exposed finally for the fraud he actually is.

  18. Just a short note to tell you about the latest DWP Jobcentre trick. At my local jobcentre, a number of people have been refusing DWP access to their accounts. This is perfectly legal. But the Jobcentre Advisors are trying to force access to the accounts, so they can view them. They also demand screen print-outs, even when the jobseeker has declined DWP access. Anyone not complying is automatically given an ES48 form for a ‘doubt’ regarding their jobsearch activity. This suspends their payments for a month, effectively a sanction. One of our claimants here found a DWP Freedom of Information request where they state that Jobmatch advisors cannot force this. He has made a complaint to his MP, and guess what ? All of these ‘doubts’ have been suspended. They cannot legally force jobseekers to violate their own request for privacy, as it breaches EU privacy law. You have a legal right to decline DWP access, not use UJ for your jobsearch, just post a public CV on it. Then turn up in the jobcentre with your evidence of jobsearch written down on an old-fashioned jobsearch record form, available from your local jobcentre.
    This avoids all of their snooping and spying activities. It is already beginning to have effect in my local jobcentre as more people get to hear of this. Please pass this on.

  19. Thanks for the post Jeff Smith, I have spoke about this for a while now yet no one seemed interested while others branded me a conspiracy nut.

    First things first Jeff Smith, YOUR NOT SAFE and as such strongly suggest you swat up on the DATA PROTECTION ACT. You see as is clearly in the UJ RULES that DWP reside as the DATA CONTROLLER. Now under the act the DATA CONTROLLER AND anyone they NOMINATE have the power to view all data to the site without PRIOR PERMISSION,ESPECIALLY YOUR PERSONAL AND OR SENSITIVE DATA AND YES ITS ALL LEGAL AND ABOVE BOARD.

    So although you cite a victory I can assure you that it will be shortly lived on the long run. Im not saying you didn’t make the right move, im saying you all have more work to do to stave of this immoral practice.

    You and your fellow claimants now need to enact your right under the DATA PROTECTION RIGHTS ACT to reasonably and legally control the flow of your PERSONAL AND OR SENSITIVE DATA in respect to second parties and especially third parties.

    Start out by reading the act, DISCOVER WHAT PROCESSING ACTUALLY MEANS UNDER LEGAL DEFINITION, DISCOVER WHAT PARTIES MEANS, DISCOVER WHAT DEFINES PERSONAL AND OR SENSTIVE DATA, DISCOVER WHEN AND WHERE THE ACT COMES INTO FORCE.

    ASSERT YOUR RIGHTS UNDER DPA to remove where you see necessary (no reason needed to be given) any and all PERSONAL AND OR SENSITIVE DATA WHERE YOU SEE FIT pertaining to yourself.

    NO FULL NAMES, NO ADDRESSES, NO PHONE NUMBERS, NO AGE, NO ACTUAL COMPANY NAMES WHERE YOU EVER WORKED, NO REFERENCES, ETC.

    Now every claimant needs to ask themselves this valuable question

    DO YOU KNOW WHERE THE SERVERS ARE THAT STORE YOUR DATA, DO YOU KNOW WHERE THE SYSTEM IS MANAGED FROM. Basically your only covered under the act IF AND ONLY IF BOTH RESIDE WITHIN THE UK AND ITS RULE. THE LAW BECOMES MUTE IF NOT.

    ALSO look at the cookies rule as DWP are lying their to as they still need your permission even if they own the PC your on as it is not the hardware but you the claimant that generates the data these cookies feed on. DID YOU KNOW ONE OF THE COOKIES STAYS ON THE SYSTEM (ANY PC) PERMANTLY unless you search it out and destroy it as normal deletion through the browser wont remove it.

    Read if you haven’t already the UJ TOOLKIT cover to cover as in it your see how they are to try to get you to use certain word terms. THEY HAVE NO LEGAL RIGHT TO DO THIS MEANING YOU CAN USE WHATEVER WORDS YOU LIKE IN YOUR PROFILE AND SEARCHES. They have done this as its possible to use words not covered in their database search engine which in turn prevents their engine generating suggested vacancies.

    YOU ARE ALSO FREE TO OPEN AND CLOSE AS MANY UJ ACCOUNTS AS YOU LIKE MEANING IF YOU WANTED TO YOU COULD OPEN AND CLOSE A UJ ACCOUNT WITH EVERY JOB YOU APPLIED TO THROUGH THE SITE ITSELF.
    Those that have been mandated to open a UJ are unmandated to moment they comply by way of demonstrating proof meaning you are no longer under mandation as regards the account you opened.

    Theirs a lot more you can do if your interested from encrypting and copyrighting your CV, Manual search scrambling and much more and YES ITS ALL LEGAL AND ABOVE BOARD.

    • GAIA. A COUPLE OF MONTHS AGO, I TELEPHONED TV LICENSING TO CLEAR UP A PROBLEM I HAD. MY NEXT CALL WAS TO THE JCP ABOUT ANOTHER MATTER TO DO WITH ESA. IN THE SPACE OF 10 MINUTES I SPOKE TO THE SAME CALL CENTRE ON TWO SEPARATE NUMBERS. IT WAS SERCO-CAPITA [FINANCE]. THE TV LICENCE CAME BACK TO ME AND FORGOT TO WITHHOLD THEIR NUMBER. I GOOGLED THE NUMBER AND IT CAME UP WITH CAPITA FINANCE

After a recent visit to the JCP a doubt was raised about my Job Search,they would not accept a print out of UJM it had to be written down,they would not accept a written down copy as “You could of written down anything” they wanted access to my UJM account,I thought long and hard about it(contested it and won) Is it mandatory? (NO) so they want to play silly games? (Fuck me Fuck you is my favourite) I now keep a log of my activities from the moment I get up 0545 until I retire at 2315 daily,from shit,shower and shave to brushing my teeth before bed,stupid?(YES) but when I sign on,so there is no misunderstanding I insist that we review all activities…Day by Day by Day….to ensure that I am not being idle…To use the JCP phrase,just following policy.

    Once upon a time there were three little pigs, who became unemployed.
    Soon they had no food in the house, and being pigs, they didn’t like it.
    They decided that one of them would have to go and sign-on at the Jobcentre.
    None of them was very keen on this idea, for the Jobcentre had a bad reputation. It was known as a place where unpleasant things happened to people known as ‘the unemployed’.

    So reluctantly, the first little pig went into town, and called at the Jobcentre
    to sign-on.
    At the desk was a wolf, called Advisor, who smiled when he saw the little pig.
    ” Hello little piggy, I’m here to help you get a job ”, he said.
    And the little pig signed all the papers that Advisor asked him to.
    And foolishly, he allowed full access to his Universal Jobmatch Account.
    He didn’t really understand this, but it seemed a good idea, and Mr.Wolf was so nice and friendly.
    But the first time that the little pig didn’t apply for a job, even though it was only part-time and very far away, he was sanctioned, and lost his Jobseekers Allowance for a month. And so the little pig ran crying all the way home, and as he now had no money, and there was no social security thanks to an evil gang called Tories, he starved to death before the end of the month.

    Now the second little pig saw what had happened to his friend, but he had no choice, and so he went down to the Jobcentre and signed-on.
    He saw the wolf, called Advisor, who tried to persuade him to allow full access to his Universal Jobmatch Account.
    But the second little pig was wiser, or thought he was, and so he declined DWP access to his UJ account.

    The wolf didn’t like this, and tried to persuade the second little pig to give him access to the UJ account. But the second little pig would not . This was awkward for the wolf, because now he couldn’t snoop on the jobseeking activities of the second little pig. He couldn’t for example see if the little pig had refused a job, or what he was applying for. He couldn’t see if he had refused to apply for a recommended job. And he couldn’t get into the account to put lots of jobs on the list for the little pig to apply for, which the wolf liked doing.

    This won’t do thought the wolf, I’ll have to try a trick to get into the UJ account. And so the wolf pretended that there was a special rule which meant that when the little pig came to sign-on he would have to let the wolf see his UJ account, and provide screen prints from it. Even though the little pig had officially declined DWP access.This wasn’t really true of course, because the little pig was protected by EU privacy law, and no access meant no viewing, and no screen prints either.

    But the second little piggy didn’t know this, and he didn’t want to annoy Mr.Wolf or lose his Jobseeker’s Allowance. So next time he visited the Jobcentre, he let the wolf see his UJ account, and provided screen prints.

    Now these screen prints showed that the second little pig had not been doing enough in his Job Activity List, and worse, that he had not applied for a job at the local bacon factory. And so the second little pig was sanctioned, and lost all his money. He would have starved to death too, but fortunately he was hit by a bus instead while crossing the road, which just goes to show.

    The third little pig was the wisest of the three, and he went down to the Jobcentre and signed-on. He saw the evil wolf Advisor, and refused to provide
    DWP access to his account. The little piggy didn’t listen to the wolf when he tried to persuade him, nor did he believe the trick about the special rule.
    And the evil wolf huffed and puffed, and threatened the little piggy.
    But the third little pig stood firm, for he knew that EU privacy law protected him. And the third little pig was able to keep his jobsearch private, away from the wolf. He didn’t have to explain why he hadn’t applied for a particular job.
    The wolf couldn’t check his jobsearch activity, or jobsearch time.
    He couldn’t put extra jobs into the account to be applied for.
    All because the little piggy had declined access and kept his privacy. In fact the third little pig didn’t use the UJ account at all, for it was a stupid thing really, and full of things to trap an unwary pig.

    So the third little pig just did what he had to do, and no more.
    He posted a public CV on the UJ account, and he provided a single print out of this, the only print out he legally had to make. He gave this to the wolf, Advisor. He logged in to the UJ account from time to time to check if any employers had offered him a job. Of course they never did, but this was part of a strange game that was played at the Jobcentre, so he didn’t mind.

    Most importantly, the third little pig did not use the UJ account at all for any jobsearching, nor put any of his applications into the online Jobsearch Activity List.
    He just ignored the whole nasty thing. He did his jobsearch using other online search engines. These were much better anyway than Universal Jobmatch, which had been designed by a monster employed by the evil Tories.

    The third little piggy wrote all of his jobsearch details down on a form that Mr. Wolf had to provide for him, even though he didn’t like this much, called a Fortnightly Jobsearch Record. He carefully filled this in every day, and came to his fortnightly sign-on with printed evidence of his jobsearch. This included Application Confirmations, which he could easily get from internet job search sites, and which were very useful for this purpose.
    So this little piggy claimed his Jobseekers Allowance and lived happily ever after. Or at least as happily as you could do, bearing in mind the continual cutbacks in the benefit system.
    And the moral of this story is, when you go down to the Jobcentre to sign-on, which little pig are you going to be ?

  26. Slightly Off Topic Has anybody ever heard of Historic Sanctions. Something has come to light regarding a reference as to why I left a job in 1997. I should have got a sanction [in their eyes] but did not. They may I have been warned bring it into play now. They have not decided yet.
